|a جاء هذا البحث بعنوان "نفقة المتعة مفهومها وحكمها في الإسلام – دراسة فقهية"، والذي هدف إلى بيان حق من الحقوق التي كفلها الإسلام للمرأة. احتوى البحث على مقدمة وأربعة مباحث رئيسة، الأول: في تعريف النفقة والمتعة لغة واصطلاحًا وبيان الفرق بينهما، الثاني: في بيان الحكمة من مشروعية نفقة المتعة وحكمها عند الفقهاء، والثالث: في بيان الأصل في مقدار نفقة المتعة واختلاف الفقهاء حول جنسها ومقدارها، والرابع: في شروط استحقاق نفقة المتعة ومسقطاتها. استخدمت في هذا البحث المنهج الاستقرائي بالإضافة للمنهج التحليلي، ولقد توصلت في خاتمة البحث إلى جملة من النتائج من أهمها: 1/ كرم الإسلام المرأة وأنصفها وأعطاها حقوقها الزوجية كاملة، ومن ضمن هذه الحقوق الحق في الإنفاق عليها. 2/ أن المتعة هي حق خاص للمرأة المطلقة، وهي مشروعة بالكتاب والسنة وأقوال الصحابة وفق شروط معينة لرفع الضرر عن المطلقة. 3/ ليس للمتعة قدر معين، بل يرجع تحديد مقدار نفقة المتعة إلى العرف حسب يسار الزوج وإعساره. 4/ تجب نفقة المتعة إذا وقع الطلاق من الزوج أو ما في معناه.
|b This research was titled "The Spending for Fun, Its Concept and Ruling in Islam A Jurisprudential Study", which aimed to clarify one of the rights guaranteed by Islam to women. The research contained an introduction and four main topics, the first: defining mut'a and mut'a expenses linguistically and idiomatically, and explaining the difference between them, the second: explaining the wisdom behind the legality of mut'a spending and its ruling according to the jurists, and the third: explaining the origin in the amount of mut'a expenses and the difference of jurists about its type and amount, and the fourth: In terms of entitlement to alimony for fun and Msqadtha In this research, I used the inductive method in addition to the analytical method, and at the conclusion of the research, I reached a number of results, the most important of which are: 1. Islam honored women, treated them fairly, and gave them all their marital rights, and among these rights is the right to spend on them 2. Mut'ah is a special right for a divorced woman, and it is legitimized by the Book, the Sunnah and the sayings of the Companions according to certain conditions to remove the harm from the divorced woman. 3. Mut'ah does not have a specific amount. Rather, determining the amount of the mut'a expense is based on custom according to the husband's wealth and insolvency. 4. The maintenance of mut'a is obligatory if the divorce takes place from the husband or the like.
