المستخلص: يعد الاستصحاب المقلوب أو المعكوس أحد أنواع الاستصحاب إلا أنه لم يحظ بالدراسة والاهتمام التي حظي بها غيره من أنواع الاستصحاب فجاءت هذه الدراسة لبيان حقيقته وحجيته، وأهم القواعد الفقهية المتعلقة به، وبيان أثره في حكم توسعة أحواض الجمرات ودراستها دراسة فقهية مقارنة، وترجع أهمية دراسة هذا الموضوع إلى اعتماد الفقهاء على الاستصحاب المقلوب في العديد من الفروع الفقهية، مما يؤكد أهمية دراسته من الناحية النظرية والتطبيقية. وقد قسمت هذا البحث إلى مقدمة وخمسة مباحث وخاتمة. تكلمت في المقدمة عن أهمية الموضوع، وأسباب اختياره، والدراسات السابقة. وجاء المبحث الأول بعنوان: حقيقة الاستصحاب وأنواعه، وكان المبحث الثاني بعنوان: حقيقة الاستصحاب المقلوب، ثم جاء المبحث الثالث بعنوان: حجية الاستصحاب المقلوب، وكان عنوان المبحث الرابع: القواعد الفقهية ذات الصلة بالاستصحاب، ثم جاء المبحث الخامس والأخير بعنوان: أثر الاستصحاب المقلوب في حكم توسعة أحواض الجمرات. وقد توصلت الدراسة لعدد من النتائج المهمة منها أن هذا النوع من الاستصحاب لم يتعرض له إلا علماء الأصول المتأخرين وباختصار شديد وبعبارات مختلفة من أشهرها: تحكيم الحال، والاستصحاب المعكوس، والانعطاف، ورجعية اليقين، كما بينت الدراسة الاستصحاب المقلوب حجة يجوز للمجتهد أن يتمسك بها ويستند إليها متى ما بذل جهده واستفرغ وسعه ولم يظفر بدليل يغير الوضع، كما بينت الدراسة أن الاستصحاب المقلوب لعب دورا مهما في جواز توسعة أحواض.

The inverted or inverted Istihab is one of the types of Istihab, but it has not received the study and attention that other types of Istihab have received. This study came to explain its truth and authority, the most important jurisprudential rules related to it, and explain its impact on the ruling on expanding the embers’ basins and studying them in a comparative jurisprudential study. The importance of studying this is due to The subject has led to jurists relying on inverted istiḥāb in many branches of jurisprudence, which confirms the importance of studying it from a theoretical and applied perspective. I divided this research into an introduction, five sections, and a conclusion. In the introduction, I spoke about the importance of the topic, the reasons for choosing it, and previous studies. The first section was entitled: The truth about istashahab and its types. The second section was titled: The truth about inverted istashahab. Then the third section was entitled: The validity of inverted isthabah. The title of the fourth section was: The jurisprudential rules related to istashahab. Then the fifth and final section came entitled: The effect of inverted istashahab on... Ruling on expanding the Jamarat basins. The study reached a number of important results, including that this type of istishab was only addressed by later scholars of jurisprudence, very briefly, and in different expressions, the most famous of which are: arbitration of the case, reverse istishab, inflection, and the return of certainty. The study also showed that inverted istishab is an argument that the diligent person may adhere to and rely on. To it whenever he exerted his effort and exhausted his effort and did not obtain evidence to change the situation. The study also showed that the inverted istishab played an important role in the permissibility of expanding basins.
