المستخلص: فإن حب الأوطان مغروس في الإنسان، وأن الإبعاد عنه؛ عقوبة أيما عقوبة؛ ولكن إذا كان الذنب المقترف في حق هذه الوطن موجب للإبعاد عنه؛ فإنها عقوبة تقتضيها مصلحة البلد، من أجل ذلك فإن النفي كان من عداد العقوبات الشرعية الواردة في كتاب الله. والعقوبات مشروعة وفيها حكم؛ منها: المنع من الإفساد في الأرض، والعقوبة بالإبعاد من أنواع العقوبات، والتي لها تأصيل فقهي وتبيين نظامي وواقع قضائي. ولأي دولة سلطة يسميها أرباب القانون: سيادة على أراضيها وإقليمهم لمنع أي من يشتبه فيه من الدخول في أراضيها دفعاً لمفسدة أو خوفاً على فوات مصلحة، وكذلك الإبعاد عند دخول. ومن هذا المنطلق؛ ولكثرة تطبيقات الإبعاد في القضاء، وورود التعاميم من صاحب الصلاحية في ذلك، وتأصيلا للجانب الشرعي في عقوبة الإبعاد أتى هذا البحث المعنون بـ: التعزير بالإبعاد دراسة فقهية نظامية قضائية.
