|a يتناول هذا المقال بالبحث والتحليل وضعية دائني المقاولة المفتوحة في مواجهتها مسطرة التسوية القضائية، وعلى الخصوص الحقوق التي خولها لهم المشرع المغربي خلال فترة تنفيذ مخطط التسوية القضائية والذي قد يتخذ شكل مخطط أو تفويت ذلك أن الكتاب الخامس من مدونة التجارة المغربية منحت للدائنين مجموعة من الحقوق في هذه المرحلة، وهذه الحقوق منها ما هو مكتسب لهم وشهد تعطيلا قبل حصر مخطط التسوية ومنها ما هو بالمساطر الجماعية ويتمثل في حق الدائن في طلب فسخ المخطط.
