|a هذا بحث فقهي قضائي تأصيلي لمسألة من أدق مسائل الاختصاص القضائي وأكثرها وقوعا في تاريخ القضاء الإسلامي، وتطبيقا في واقع الدول ومنها المملكة العربية السعودية؛ وهي الاختصاص القضائي النوعي؛ الذي يقوم على تعدد جهات التقاضي وتعدد القضاة في البلد، واختصاص كل منهم بعمل ينظره دون الآخر، أو يمنع من نظره لكونه من اختصاص الآخر، تناولت فيها تعريف الاختصاص القضائي النوعي، وبيان المقصود به، وبيان حكمه وأدلة مشروعيته، وفوائده وثمراته، وأنواعه ومعايير تحديده، وأشهر صوره التي ظهرت في تاريخ القضاء في الإسلام، مع بيان التطبيق الجاري في النظام السعودي، مع بيان أحكام التنازع في الاختصاص القضائي النوعي وطرق حله حين وقوعه، ثم ختمت البحث بأهم النتائج التي توصل إليها، وفهرس المصادر والمراجع، وقد سرت في البحث وفق المنهجية العلمية المتبعة في كتابة البحوث والدراسات الأكاديمية، ورجعت إلى المصادر المعتمدة في الفقه والنظام، وأسأل الله تعالى أن ينفع به، وأن يجعله خالصا لوجهه الكريم.
|b This is judicial jurisprudential research, which is based on the Sharia, deals with on one of the most precise and frequently occurring issues of judicial jurisdiction in the history of Islamic judiciary, and in the reality of countries, including the Kingdom of Saudi Arabia. It is the specific jurisdiction, which is based on the multiplicity of litigation bodies and the multiplicity of judges in the country, and the jurisdiction of each of them for a task to the exclusion of the other, or each of them being prevented from considering a case because it is within the jurisdiction of the other. The research tackles the definition of specific judicial jurisdiction, evidence of its legitimacy, its benefits and fruits, its types and the criteria for determining them, and its most famous forms that appeared in the history of the judiciary in Islam. The research introduces the current application in the Saudi system, with an explanation of the provisions for conflict in specific judicial jurisdiction and methods for resolving it when it occurs.
