|a إن صدور القانون رقم 66-12 جاء على ضوء تزايد الاهتمام الكبير الذي توليه الدولة المغربية لمختلف القضايا التي تخص التعمير والبناء على جميع المستويات، خصوصاً أمام استفحال ظاهرة البناء غير القانوني، وظهور الكثير من التجزئات السكنية المخالفة للنصوص القانونية والتنظيمية، ونتيجة ذلك توجه المشرع المغربي من خلال هذا القانون إلى استثناء معاينة ومراقبة المباني المخالفة لقانون التعمير من اختصاصات رؤساء المجالس الجماعية، وتركيزها في يد رجال السلطة الممثلين الخاصين بالسلطة الإدارية المحلية وهذا من أجل التصدي وأيضاً الحد من مخالفات التعمير والبناء. لغرض تحقيق النجاعة والحكامة في مجال التعمير.
|b The issuance of Law No. 12-66 came in light of the increasing great interest that the Moroccan state pays to various issues related to reconstruction and construction at all levels, especially in the face of the growing phenomenon of illegal construction and the emergence of many residential subdivisions that violate the legal and regulatory texts. As a result, the Moroccan legislator directed Through this law, the inspection and monitoring of buildings in violation of the construction law is excluded from the powers of the heads of collective councils, and it is placed in the hands of the authority agents who are the representatives of the local administrative authority. This is in order to confront and also limit construction and construction violations, for the purpose of achieving efficiency and governance in the field of construction.
