|a يعتبر العقار من عوامل الإنتاج الأساسية التي تتسم بالحوية والحساسية، ولهذا الاعتبار فقد خصها المشرع بحماية تشريعية توائم حجم الدور الذي تضلع به، وذلك من خلال إيلاء الأهمية الكبرى لاستقرارها وثباتها، وهذا ما نجده بارزا بشكل كبير في ظهير التحفيظ العقاري الذي يروم تحقيق هذه الغاية بالأساس. لكن الوصول لهذا الهدف قد يصدم بمبادئ قانونية أخرى لها اعتباراتها كضابط استقرار المعاملات الذي يروم تحقيق الثبات والاستقرار لكن في باب المعاملات وقاعدة التطهير التي ترمي لتطهير العقار من جميع الحقوق التي لم يقع الاحتجاج بها أثناء سريان مسطرة التحفيظ والتي تروم الحفاظ على استقرار الملكية العقارية، الشيء الذي يطرح سؤال الأولوية التي تقتضي المفاضلة بين استقرار المعاملات واستقرار الملكية العقارية وبين التوفيق الذي يقتضي الجمع والتألف بينها.

For this reason, it is protected by legislative measures that reflect the extent of its importance and aim to achieve stability and permanence. This is particularly evident in the field of real estate registration, which seeks to achieve this goal. However, this objective may conflict with other legal principles, such as the stability of transactions and the principle of purification, which aims to purify the property from any rights that have not been claimed during the registration period and to maintain the stability of real estate ownership. This raises the question of priority, which requires a preference between the stability of transactions and real estate ownership and the compromise that is necessary to reconcile them.
