|a لقد تفشت ظاهرة السرقة العلمية وشكلت تهديدا للبحث العلمي وإخلالا بالأمانة العلمية، مما أدى بكثير من المختصين إلى إنشاء برامج حاسوبية كاشفة لها ووضع قوانين رادعة للحد منها، كما دفع إلى مناقشة التساؤلات القانونية التي تثيرها ومنها الإشكالية التي عالجتها هذه الورقة البحثية ومفادها: ما هي الآليات المتبعة للحد من السرقة العلمية؟ ما طبيعة المسؤولية الجنائية المترتبة عليها في الفقه الإسلامي والقانون الوضعي؟ وقد توصلت الدراسة إلى جملة من النتائج أهمها: ضرورة التوثيق العلمي، حتمية وضع عقوبات رادعة لسارق الإنتاج العلمي، مع تبني أنظمة محكمة لحماية الحقوق الفكرية للباحث.
|b The phenomenon of scientific theft has become widespread and constitutes a threat to scientific research and a breach of scientific integrity, which has led many specialists to create computer programs that detect it and put in place deterrent laws to limit it. It has also prompted a discussion of the legal questions it raises, including the problem that this research paper has addressed: what are the methods used to reduce scientific theft? What is the nature of the criminal liability resulting from it in Islamic jurisprudence and positive law? The study reached a number of results, which are: The necessity of scientific documentation, the inevitability of establishing deterrent penalties for those who steal scientific production, and adopting strict systems to protect the intellectual rights of the researcher.
