|a هدفت إلى بيان أهمية الزواج ودوره في استقرار الأسرة وتماسكها، ومدى تحقيقه للمودة والرحمة بين الزوجين، كما هدفت إلى بيان كمال الشريعة الإسلامية، وصلاحيتها لكل زمان ومكان، وقدرتها على حل المشكلات التي تواجه الزوجين كالهجر والنشوز وغيرها. والمنهج المتبع في كتابة هذا البحث المنهج الاستقرائي القائم على جمع واستقراء المعلومات المتعلقة بالموضوع، والمنهج التحليلي الذي اعتمد تحليل الأسباب لهذه المشكلة، والمنهج الاستنباطي للوصول إلى وسائل علاجية لها. احتوى البحث على خمسة مباحث رئيسة، الأول: مفهوم الهجر والنشوز، وبيان أنواع الهجر في الإسلام، الثاني: ذم الهجر والنهي عنه، وبيان حكم هجر الزوجة لزوجها في الإسلام، الثالث: في أسباب هجر الزوجة لزوجها، والرابع: في الآثار المترتبة على هجر الزوجة لزوجها والخامس: في علاج مشكلة هجر الزوجة لزوجها. وقد توصل البحث إلى عدد من النتائج من أهمها: 1- هجر الزوجة لزوجها معناه: كراهيتها له وامتناعها عن إعطائه حقوقه الشرعية، والتعالي عليه وامتناعها عن طاعته. 2- هجر الزوجة لزوجها جائز إذا اضطرت إلى ذلك، كان يظلمها ولا يعطها حقها، ما لم يصل بالزوجة إلى ترك طاعة الزوج والنشوز عليه.
|b It is a jurisprudential study, as it aims to explain the importance of marriage and its role in the stability and cohesion of the family and the extent to which it achieves affection and compassion between spouses. It also aims to demonstrate the perfection of Islamic law, its validity for every time and place, and its ability to solve the problems facing spouses, such as abandonment, discord, and others. The researcher used the inductive approach, which involved collecting and extrapolating information related to the subject, the analytical approach, which involved analyzing the causes of this problem, and the deductive approach to arrive at remedial means. The most important results are as follows: 1-A wife abandoning her husband means her hatred for him, her refusal to give him his legal rights, her condescension, and her refusal to obey him. 2-It is permissible for a wife to leave her husband if she is forced to do so if he treats her unjustly and does not give her rights unless this leads the wife to abandon obedience to the husband and disobey him.
