|a يعد الاتجار بالبشر إحدى أخطر الجرائم التي تستهدف العنصر البشري، لما تنطوي عليه من انتهاك صارخ لحقوقه وحرياته الأساسية واعتباره سلعة قابلة للبيع والشراء وموضوعا للمتاجرة. وبالنظر لخطورة هذه الجرائم وانتشارها الواسع على المستوى الدولي، فقد بادر المجتمع الدولي ومعه مجموعة من الدول بما فيها الدول العربية إلى سن مجموعة من النصوص القانونية بهدف مواجهة ومكافحة هذه الجرائم وحماية ضحاياها وملاحقة ومعاقبة مقترفيها. على هذا الأساس انصبت هذه الدراسة على محاولة الوقوف طبيعة الآليات التشريعية التي سعت من خلالها الدول العربية والمجتمع الدولي إلى إيجاد سبل كفيلة بمواجهة هذا النوع من الجرائم. كما انصبت هذه الدراسة كذلك على محاولة الوقوف على ماهية هذه الجرائم من خلال بيان مفهومها وخصائصها، وكذا من خلال الكشف عن أهم الأسباب والعوامل التي تسهم في شيوعها وانتشارها.
|b Human trafficking is one of the most serious crimes targeting the human race, as it involves a flagrant violation of its basic rights and freedoms and considers it a commodity that can be bought and sold and an object of trade. Due to the seriousness of these crimes and their wide spread at the international level, the international community and a number of countries, including Arab countries, have worked to enact a set of legal texts with the aim of confronting and combating these crimes. On this basis, this study focused on trying to know the nature of the legislative mechanisms through which the Arab countries and the international community sought to find ways to confront this type of crime. This study also focused on trying to clarify the concept and characteristics of these crimes, as well as revealing the most important causes and factors that contribute to their spread.
