|a تعد جريمة التشهير من الجرائم التي أصبحت شائعة في المجتمعات وذلك راجع إلى التقنيات الجديدة التي سهلت عملية النشر كالجرائد الإلكترونية ومواقع التواصل الاجتماعي التي جعلت من العالم قرية صغيرة، لذلك لجأت مجموعة من التشريعات منها التشريع المغربي إلى التصدي لهذه الظاهرة عن طريق الموازنة بين تجريم نشر المعلومات الزائفة أو المسيئة والترويج لها وإعادة نقلها بهدف الأضرار بسمعة الأشخاص والنيل من كرامتهم دون المس بحقهم وحريتهم في التعبير عن آرائهم.
|b Defamation has become a common crime in societies, largely due to the proliferation of new technologies that facilitate dissemination, such as electronic newspapers and social media platforms, which have turned the world into a small village. Consequently, various legislations, including Moroccan law, have taken measures to combat this phenomenon by balancing between criminalizing the dissemination of false or defamatory information and promoting it with the intention to damage individuals' reputations and dignity without infringing on their rights and freedom of expression.
