|a يهتم هذا البحث بالتعرف على قانون أساس "إسرائيل.. الدولة القومية للشعب اليهودي 2018" والذي يعد واحدًا من أهم القوانين التي أقرت حديثا. ويهدف البحث إلى التعرف على أهم المقترحات الأولية لهذا القانون والنص النهائي والمقارنة بين ما تضمنته هذه المقترحات وما خرج في النص النهائي ومدى تعبير محتوى هذه المقترحات ومحتوى النص النهائي عن التوجهات الأيديولوجية والسياسية لمقدّميه، وبعد ذلك التعرف على حالة الجدل والآراء المختلفة حول قانون القومية سواء من داخل المجتمع الإسرائيلي، من أكاديميين وسياسيين أو من عرب 1948 أو من الفلسطينيين، المعرفة توجه كل طرف إزاء محتوى قانون القومية ورؤيته لتأثيراته وتداعياته، ودلالات هذا الجدال من التيارات السياسية المختلفة وتوجهاتها. ثم يتطرق البحث إلى قراءة المادة الأولى في قانون القومية وهي "المبادئ الأساسية"- والتي تحتوي على ثلاثة بنود - في ضوء مصادر التشريع الديني اليهودي وبخاصة في نصوص المقرا، والتلمود، لمعرفة مدى تأثر قانون القومية بالأفكار الدينية وتفسيراتها. ويتبع البحث المنهج الوصفي في دراسة مواد القانون ومعرفة جذورها الدينية والأيديولوجية في ضوء مصادر التشريع الديني اليهودي.
|b This research attempts to explore the "Basic Law: Israel as the Nation-State of the Jewish People" (2018) that is considered one of the most important newly passed laws. The research aims to identify the most important preliminary proposals for this law and its final text, comparing between them, and showing to what extent they reflect the ideological and political orientations of its sponsors. Then the research identifies the state of controversy and different opinions about the nation-state law, whether from within Israeli society; academics and politicians, or from the Arabs of 1948, or from the Palestinians. to know the orientation of each party towards the content of the nation-state law and its vision of its effects and repercussions, and the implications of this controversy from different political currents and their orientations. The research finally conducts a reading of the first article of the Nation-State Law, which is the basic principles-containing three items- in light of the sources of Jewish religious legislation. Especially in the texts of the Muqra and the Talmud, to see the extent to which the nation-state law is influenced by religious ideas and interpretations. This research follows a descriptive approach in the study of law articles and knowledge of their religious and ideological roots in the sources of Jewish religious legislation.
