|a تناقش الدراسة أهم الجرائم الدولية: الإبادة الجماعية، جرائم الحرب، والجرائم ضد الإنسانية باعتبارها انتهاكات لحقوق الإنسان في ضوء القانون الدولي متخذة غزة نموذجا. وتقوم الدراسة بإلقاء الضوء على أهم الجرائم الدولية التي وردت في نظام روما الأساسي للمحكمة الجنائية الدولية المعتمد في روما في ١٧ يوليو ۱۹۹۸، والتي وردت على سبيل الحصر بنص المادة الخامسة. وكذلك تركز الدراسة على انتهاكات حقوق الإنسان وارتكاب قوات الاحتلال الإسرائيلي للجرائم الدولية في قطاع غزة مخالفة لقواعد القانون الدولي ولمقررات الشرعية الدولية، وذلك من خلال ثلاثة محاور، يعرض الأول منها لجريمة الإبادة الجماعية، والثاني: الجرائم ضد الإنسانية، والثالث: جرائم الحرب. وقد أوضحت الدراسة أن الجرائم الدولية التي ارتكبتها قوات الاحتلال الإسرائيلي بقطاع غزة تشكل انتهاكات خطيرة متمثلة في جرائم الإبادة الجماعية، وجرائم الحرب، والجرائم ضد الإنسانية، وذلك بموجب القانون الدولي الإنساني (المواد ٥-٧-٨) من نظام روما الأساسي للمحكمة الجنائية الدولية.
|b The study discusses the most important international crimes: genocide, war crimes, and crimes against humanity as violations of human rights in light of international law, taking Gaza as an example. It sheds light on the most important international crimes mentioned in the Rome Statute of the International Criminal Court adopted in Rome on July 17, 1998, and which were exclusively mentioned in the text of Article Five. The study also focuses on human rights violations and the Israeli occupation forces committing international crimes in the Gaza Strip in violation of the rules of international law and the decisions of international legitimacy, through three pillars, the first of which presents the crime of genocide, the second: crimes against humanity, and the third: war crimes. The study showed that the international crimes committed by the Israeli occupation forces in the Gaza Strip constitute serious violations represented in genocide, war crimes, and crimes against humanity, in accordance with international humanitarian law (Articles 5-7-8) of the Rome Statute of the International Criminal Court.
