المستخلص: هذا البحث في أثر التوبة من الذنوب على الأحوال الشخصية، والذي يهدف إلى جمع أبرز المخالفات الشرعية في الأحوال الشخصية، وأثرها على أحكام الأسرة، وبيان أثر التوبة منها على القول الراجح، سواء الذنوب التي لها أثر على العقد كالكفر، والردة، وقذف الرجل زوجته بالزنا كاذبا، والزواج بأكثر من أربع نسوة، أو التي لها أثر على الولاية، كولاية الفاسق في التزويج والحضانة، أو التي لها أثر على الوطء، كالوطء في الحيض، والوطء قبل الكفارة في الظهار، أو التي لها أثر على العشرة الزوجية، كامتناع المرأة من طلب زوجها الجماع، والنشوز، وعدم العدل بين الزوجات في المبيت، أو التي لها أثر على العدة، كترك المرأة الإحداد على زوجها، وخطبة المعتدة. وقد كان للتوبة آثار في صحة العقد، ورجعة الولاية، وجواز الوطء، ودوام العشرة بين الزوجين، إذا التزم الزوجان بالأحكام الشرعية، وترك المخالفات والمنهيات في الأحوال الشخصية.

This research demonstrates the impact of repentance from sins on personal status. The research aims at tracing the most prominent legitimate violations in personal status and their influence upon family rulings. In addition, the research investigates the impact of repentance from those violations on the preponderant saying. The research has specified five types of violations. First, the violations or sins that affect the contract like infidelity, apostasy, a man falsely accusing his wife of adultery and marrying more than four women. Second, those violations which affect guardianship such as the guardianship of an immoral person in marriage and custody. Third, the violations that affect intercourse, such as having intercourse during menstruation, and intercourse before expiation for Zihar. Fourth, those violations which have an impact on marital relations, such as a woman refraining from asking her husband to have intercourse, disobedience, and unfairness between wives in spending the night. Fifth, the violations which have an impact on the waiting period, such as a woman refraining from mourning her husband, and proposing to a woman observing the waiting period. To sum up, repentance has had effects on the validity of the contract, the restoration of guardianship, the permissibility of intercourse, and the continuity of intercourse between the spouses, if the spouses adhere to the legal rulings and abandon the violations and prohibitions in personal status.
