المستخلص: الأهداف: البحث بيان ماهية أثر تخصيص العموم في الاجتهاد الفقهي في باب العبادات من خلال عرض القواعد الأصولية المتعلقة بالعموم والخصوص وتفريع الأحكام الفقهية المخرجة على تلك القواعد، وتسليط الضوء على أثر تخصيص العموم في اجتهاد الفقهاء في آرائهم الفقهية بناء على مذاهبهم في التخصيص. المنهجية: استخدم الباحث المنهج الوصفي. النتائج: توصل البحث إلى أن دلالة العموم على أفراده ظنية على القول المختار وللعموم ألفاظ خاصة تدل عليه، وأن مخصصات العموم تنقسم إلى مخصصات منفصلة ومتصلة وهناك خلال بين الأصوليين في اعتبار تخصيصها على وجه الإجمال، وتخصيص العموم له أثر كبير في اجتهاد الفقهاء، وذلك من خلال النظر إلى اختياراتهم الفقهية من خلال عرض التطبيقات السابقة. الخلاصة: يجب الاهتمام بمبحث دلالات الألفاظ عموما وتخصيص العموم على وجه الخصوص من الباحثين من استثمار تلك القواعد التي تمكنهم من استنباط الأحكام بشكل سليم من الخطأ في الفتوى والإكثار من الدراسات التطبيقية لمبحث العام والخاص على الفروع الفقهية القديمة والمعاصرة لإيجاد أحكام منضبطة للنوازل الفقهية المستجدة.

The present research aims at displaying the importance of specifying the generalities of jurisprudence in the chapter assigned to the acts of worship through demonstrating the fundamentalistic rules related to the general and specific as well as classifying the jurisprudential provisions authenticated according to those rules. In addition, the research highlights the impact of specifying the generalities in the diligent work of the jurists regarding their jurisprudential opinions relying on their schools of specification. The research applies the descriptive approach. By the end of the research, the researcher has referred to the most important findings. For instance, the meaning of the generality indicated by its constituents speculatively relies on the chosen statement and the generality has its special indicative words. Moreover, the general allowances are divided into separate and connected allowances and there is disagreement among the fundamentalists in considering their allocations as a whole. Besides, allotment of the general has a significant impact on the efforts of the scholars through looking at their jurisprudential choices by presenting the previous applications. To sum up, researchers should pay more attention to the significance of words in general and specify the generalities in particular. They should also make use of the rules which enable them to derive rulings devoid of errors as for fatwah. Finally, researchers should increase the number of applied studies dedicated to studying the general and specific within the old and contemporary branches of jurisprudence to find disciplined provisions for emerging jurisprudential issues.
