|a يسلط البحث الضوء على قضية من القضايا المهمة التي أنتجتها الصراعات المعاصرة بين تيارات التطرف بكلا جناحيه وبين الوسطية والاعتدال، حيث تصوب التهم من التيارات الحداثية والعلمانية إلى نصوص الفقهاء لتسفيههم والحط من شأنهم، وتأويل كلامهم بما يتنافي مع المنطق، ويعد وحشية بحيث ينفر منه عموم الناس، في حين تتخذ تيارات التطرف الديني من بعض نصوص الفقهاء مسوغا لأفعالهم الإجرامية، واستباحة حقوق الإنسان بمزاعم شرعية !! وأقوال براقة !! مستندين أيضا إلى بعض نصوص الفقهاء، والإشكالية التي وقعت فيها تيارات التطرف المعاصرة بأجنحتها الخبيثة المتعددة اليمينية واليسارية تكمن في سوء فهم كلام الأئمة وتنزيله على الواقع لتمرير أغراضهم السيئة، وتزيين أفعالهم الخبيثة، وهيهات!!!!! وفي هذا البحث رصد لبعض المسائل، كما يصورها أصحابها، وتحليلها تحليلا علميا موضوعيا. وقد اعتمدت في كتابة هذا البحث على عدة مناهج: المنهج الوصفي: حيث أقوم بوصف مسائل البحث، وصفا يكشف عن طبيعتها، ويرصد آثارها، والمنهج التحليلي: حيث أقوم بتحليل مسائل البحث في ضوء علوم الشريعة وفهم التراث فهما صحيحا، ومنهج الاستدلال الاستنباطي: حيث يتم تنزيل الأحكام الشرعية من خلال النصوص والمبادئ العامة، كما يتم التخريج على نصوص الفقهاء بما يظهر معه كمال الشريعة وشمولها وصلاحيتها لكل حال وزمان ومكان، ونسأل الله تعالى التوفيق والسداد.
|b This research highlights one of the most important issues that arises because of the contemporary conflicts between the extremist trend with its two wings and moderation. The accusations raised by the secular and modernist trends against texts of the jurists aim at belittling and dishonoring these jurists as well as interpreting their words in a way that defies logic. This is considered a kind of atrocity which purposefully targets turning the texts into repulsive entities for the public whereas the religious extremist trends take some juristic texts as justification for their criminal acts and violation of human rights through legitimate claims and bright sayings relying also on some texts of the jurists. The problem of the contemporary extremist trends with their numerous evil wings; rightest or leftist, lies in their misunderstanding of the words of the Imams and projecting them to reality to achieve their devilish purposes and beautifying their evil works but this would never happen! Accordingly, this research traces some issues as delineated by their owners and analyzes them objectively and scientifically. The research relies on some writing methodologies such as the descriptive approach where the researcher describes the issues of this research in a way that uncovers their nature and registers their influences. It also utilizes the analytical approach to analyze the issues included in the light of Sharia sciences and perceiving the heritage properly. Finally, the research uses the deductive reasoning approach where the legitimate provisions are extracted through the texts and the general principles as well as referencing texts of the jurists in accordance with the completeness of the Islamic Sharia, its universality and validity for all times and places.
