تعد الاستثمارات الأجنبية من أهم السياسات التي تتبعها الحكومة المصرية، حيث تهتم بتوفير البيئة الاستثمارية التي تعمل على تحفيز الاستثمار الأجنبي المباشر، وغير المباشر، وإزالة كافة المعوقات التي تواجه المستثمر الأجنبي. وفي سبيل تحقيق ذلك صدر قانون الاستثمار رقم 72 لسنة 2017 والذي منح المستثمر الأجنبي مزايا عديدة لا تتوفر في كثير من الدول المضيفة للاستثمار، وترتب على ذلك القانون زيادة الاستثمارات الأجنبية إلى مصر، حيث قفزت الاستثمارات الأجنبية في مصر إلى 47.3% بمقدار 1.429 مليار دولار خلال الفترة من يناير حتى مارس 2021 مقارنة مع الفترة نفسها من العام الماضي، ونتج عن ذلك زيادة الاستثمارات الأجنبية المباشرة الواردة إلى مصر بغرض تأسيس شركات جديدة خلال الربع الثالث للعام المالي 2020/ 2021 بنسبة ارتفاع قدرها 85% مقارنة بالربع الأول من ذات العام. ولذلك نستطيع القول بأن هناك زيادة هائلة في تدفقات رؤوس الأموال الأجنبية، حيث أن مناخ الاستثمار في مصر جاذب للاستثمار وقد تناولنا هذا البحث من خلال ثلاثة مباحث، عالجنا في المبحث الأول تعريف الاستثمارات الأجنبية وأنواعها، وخصصنا المبحث الثاني والعوائق التي تواجه المستثمر الأجنبي في مصر، وعالجنا في المبحث الثالث منازعات عقود الاستثمارات الأجنبية ووسائل تسويتها، وتناولنا في الخاتمة النتائج والتوصيات وقائمة المراجع التي تم الاطلاع عليها. أرجو من الله العلي القدير أن يكون هذا البحث قد ساهم في إيضاح أهمية الاستثمار الأجنبي في مصر الذي يعد خطوة هامة نحو تحقيق أهداف التنمية الاقتصادية المستدامة، والله ولي التوفيق.
Foreign investments are among the most important policies pursued by the Egyptian government, as it is concerned with providing an investment environment that stimulates foreign direct and indirect investment, and removes all obstacles facing the foreign investor. In order to achieve this, Investment Law No. 72 of 2017 was issued, which granted the foreign investor many advantages that are not available in many countries hosting investment, and this law resulted in an increase in foreign investments to Egypt, as foreign investments in Egypt jumped to 47.3%, amounting to 1.429 billion dollars during the period From January to March 2021 compared to the same period last year, which resulted in an increase in foreign direct investments coming to Egypt for the purpose of establishing new companies during the third quarter of the fiscal year 2020/2021, an increase of 85% compared to the first quarter of the same year. Therefore, we can say that there is a huge increase in foreign capital flows, as the investment climate in Egypt is attractive to investment. We dealt with this research through three sections. In the first section, we dealt with the definition of foreign investments and their types, and we allocated the second topic and the obstacles facing the foreign investor in Egypt, In the third section, we dealt with foreign investment contract disputes and the means of settling them. In the conclusion, we dealt with the results, recommendations and a list of references that were reviewed. I hope to God Almighty that this research has contributed to clarifying the importance of foreign investment in Egypt, which is an important step towards achieving the goals of sustainable economic development, and God is the Grantor of success.
