المستخلص: الحكم على الشيء فرع عن تصوره؛ ليطابق الحكم الواقع، والنوازل تمثل مشكلة كبرى؛ إذا لا تصور لها في اللغة غالبا يسبق وجودها، ولا يعرف للنوازل اصطلاح سابق عن تاريخ نزولها بالناس، ومن هنا تتضح إشكالية مصطلحات النوازل؛ إذ الوقوف على تأصيل المصطلحات المتعلقة بجائحة كرونا منطلقا مهما في معالجة القضايا الناتجة عنها. وتتمثل مشكلة البحث في الجواب عن السؤال التالي: ما آلية صياغة مصطلحات النوازل؟ وما أثر تلك الصياغة على المعالجة الفقهية والقانونية؟ ومن أهم فروض البحث أنه لا توجد آلية محددة في الوقت الراهن لصياغة مصطلحات النوازل شرعا أو قانونا. وترجع أهمية البحث إلى تأصيل منهجية صياغة مصطلحات النوازل، وبيان ما ينتج عن الخلل فيها. ويعتمد البحث على المنهج التحليلي المقارن للوقوف على حقيقة المصطلح بين اللغة والشرع والقانون. ويأتي البحث في مبحثين أولهما: الإشكالية والخلاف، والآخر: الخلل الاصطلاحي والآلية المقترحة، وخاتمة وفيها أهم النتائج، ومنها: أن الجائحة تكون في السنة الجدبة، واجتياح الأموال، والمصيبة العظيمة التي تجتاح الأموال، والآفة التي تجتاح المال؛ فمصطلح جائحة كرونا غير صحيح، ويصدق مصطلح الوباء على كرونا، وهو البديل الصحيح لمصطلح الجائحة، والحكم على كورونا بأنها جائحة يصرف الأحكام الشرعية والقانونية من أحكام الوباء وما يترتب عليه من مسائل تخص هلاك الأنفس إلى أحكام أخرى تخص هلاك الثمر، ولهذا يجب تحديد المصطلحات بدقة وفق الآلية المتصورة لصياغة مصطلحات النوازل.

The research relies on the comparative analytical approach to find out the truth of the term between language, Sharia and law. The research comes in two topics, the first: The Problematic and disagreement, and the other: terminological imbalance and the proposed mechanism, concluding: the most important results, among them: The pandemic is in the arid year, money decimation, And the great Catastrophe that is decimation the money, And the pest that decimation the money, the term "corona pandemic" is incorrect, the term "epidemic" is true of corona,, which is the correct alternative to the term pandemic, Judging Corona as a pandemic distracts the Sharia rulings and legal rulings from the provisions of the epidemic, And the consequent issues related to the destruction of souls to other provisions related to the destruction of fruits, Therefore, the terminology must be precisely defined according to the envisaged mechanism for formulating the terminology of calamities.
