يوجد دور مهم لمأموري الضبط القضائي في جمع الاستدلالات وإقامة الدعوى الجزائية إذ أن مرحله جمع الاستدلالات والبحث عن الآثار المتخلفة عن جريمة ما وإزالة الغموض فيها ومعرفه أسباب وملابسات ارتكابها؛ وبالتالي كشف الفاعل وتقديمه إلى العدالة استنادا إلى الآثار والأدلة التي تم التوصل إليها من قبل مأموري الضبط القضائي؛ حيث تأتي هذه الدراسة لتسليط الضوء على الواجبات التي فرضها المشرع والصلاحيات الممنوحة لمأموري الضبط القضائي من خلال قيامهم بجمع الاستدلالات وإقامة الدعوى وضرورة توافق هذه الإجراءات الواردة مع التشريع الفلسطيني ومع المعايير الدولية والتي تراعي احترام حقوق الإنسان وكرامه المواطن وعدم إفلات الفاعل من تبعات أفعاله خاصة أثناء قيام مأموري الضبط القضائي بواجباتهم في البحث والاستقصاء وجمع الاستدلالات وكذلك معرفة الإجراءات التي يتبعها مأموري الضبط القضائي أثناء القبض على المتهم في الأحوال العادية والصلاحيات الممنوحة لهم في إجراء التفتيش والقبض على الفاعل في حالات التلبس وضرورة التزام مأموري الضبط القضائي بالحيادية المطلقة أثناء عملهم. والتعامل مع الفاعل على أنه ضحية ظروف معينة يجب مساعدته لتجاوز هذه المحنة ضمن الإجراءات القانونية.
Criminal investigation officer plays an important role in gathering evidence and instituting criminal proceedings; since that the stage of collecting evidence and searching for traces of a crime, removing ambiguities, and knowing the causes of circumstances and the reasons behind a crime are necessary to identify the perpetrator and bring him to justice This study highlights the duties and the powers imposed by the legislator and conferred to a criminal investigation officer in the course of his efforts gather evidence and institute proceedings. The necessity of these measures is that they should conform to Palestinian legislation and international standards, Furthermore, these measures should consider respecting human rights and citizens' dignity, and the fact that the perpetrator does not escape the consequences of his actions while criminal investigation officers are carrying out their duties in investigating and collecting evidence. The officer should be aware of the procedures followed in the course of arresting a suspect in normal circumstances and powers that he has in cases of flagrante delicate, which are granted to him in order to conduct search and arrest of the perpetrator. Also, the officer must act absolute impartiality while on duty, treat the perpetrator as a victim of a specific circumstance, and help the perpetrator through legal proceedings.
