|a تلقي هذه الدراسة الضوء على أحد التحديات التي يواجهها القانون الدولي الإنساني في وقتنا المعاصر وهي التداعيات التي نشأت عن ظهور الإرهاب كطرف في النزاعات المسلحة غير الدولية حيث خلق ظروف قانونية وعملية مثلت عائقا أمام إيصال المساعدات الإنسانية في مناطق النزاع المسلح. وتمثلت الظروف القانونية في السياسات والتدابير التشريعية لمكافحة الإرهاب والتي كان لها انعكاسات سلبية سواء على تمويل المنظمات الإنسانية أو على المبادئ التي تحكم تقديم المساعدات الإنسانية، أما الظروف العملية فتجسدت في ظاهرة تسييس المساعدات الإنسانية، فمن جانب تضع الجماعات الإرهابية العراقيل أمام المساعدات الإنسانية أو تستأثر بها لنفسها، وتستخدم القوة مع العاملين بالمجال الإنساني، وعلى الجانب الآخر، تسعي الحكومات جاهدة إلى عدم وصول المساعدات الإنسانية إلى مناطق سيطرة الإرهابيين، وبين هذا الجانب وذاك يوجد المدنيين الذين يخضعون لسيطرة الإرهابيين وهؤلاء هم الضحية لهذا الاستغلال السياسي للمساعدات الإنسانية، وتقودنا الدراسة إلى حل هذه الإشكالية ووضع حد لهذه التداعيات من خلال إيجاد سبل للمواءمة بين متطلبات الأمن والاحتياجات الإنسانية وتستعرض في هذا السياق عدد من الممارسات الجيدة وتقيمها، ثم التزامات الدول وفق القانون الدولي الإنساني المتعلقة بالأنشطة الإنسانية والتي يتعين أن تتقيد بها عند إعداد وتنفيذ تدابير وسياسات مكافحة الإرهاب.
|b This study sheds light on one of the challenges faced by international humanitarian law in our modern era, which are the repercussions arising from the emergence of terrorism as a party in non-international armed conflicts. This has created legal and practical conditions that have posed obstacles to the delivery of humanitarian aid in areas of armed conflict. The legal conditions are represented in the policies and legislative measures to combat terrorism, which have had negative reflections on both the funding of humanitarian organizations and the principles governing the provision of humanitarian aid. The practical conditions are embodied in the phenomenon of politicizing humanitarian aid. On one hand, terrorist groups hinder humanitarian assistance or monopolize it for themselves, and use force against humanitarian workers. On the other hand, governments strive to prevent humanitarian aid from reaching areas under the control of terrorists. Between these two sides, there are civilians who are under the control of terrorists and who are victims of this political exploitation of humanitarian aid. The study leads us to a solution to this problem and to put an end to these repercussions by finding ways to balance security requirements with humanitarian needs. In this context, it reviews a number of good practices and evaluates them, followed by the obligations of states according to international humanitarian law related to humanitarian activities, which must be adhered to when preparing and implementing counter-terrorism measures and policies.
