بسبب التطور السريع لتقنيات الذكاء الاصطناعي واستخدامها في كافة مجالات الحياة، أصبح من المتصور أن تقع الأخطاء في أعمال كيانات الذكاء الاصطناعي، خاصة في ضوء البرمجة المتطورة لبعض هذه الكيانات، التي قد تصل خطورتها في المستقبل إلى حد القدرة على اتخاذ القرارات بشكل مستقل، وما ينتج عن هذا التطور من تصور قيام تطبيقات الذكاء الاصطناعي بأعمال ينتج عنها جرائم، وربما تقوم بهذه الأعمال مستقبلا بإرادة منفردة بعيدا عن المالك أو المبرمج، وهو ما يستوجب بحث المسؤولية الجنائية المترتبة عن هذه الجرائم لتحديد المسؤول الحقيقي عنها وتوقيع الجزاء القانوني عليه، وتعتبر الدراسة من الدراسات الاستشرافية، وتتبع المنهج الوصفي التحليلي من خلال وصف الأفكار والمعطيات التي أفرزتها تقنيات الذكاء الاصطناعي، للوصول إلى المنطق القانوني الأمثل، والتكييف القانوني الأقرب للتطبيق في ضوء النظريات الفقهية، المتصلة بالمسؤولية الجنائية.
Because of the up growth of artificial intelligence techniques to be employed in all spheres of life, accidents are expected to be made where artificial intelligence entities serve, particularly given the sophisticated programming of some of these entities; what might put the whole world at risk in the future should these entities be capable of taking independent decisions, not to mention the consequences of the notion of crimes generated by actions carried out by these entities. These actions might be implemented in the future unilaterally, without the consent of the owner or the programmer, which calls for an examination of the Criminal liability arising from these crimes to determine the real Responsible persons and hold them liable. This study tends to be considered one of the perspective studies that pursue a descriptive analytical approach through setting out ideas and data produced by artificial intelligence techniques, and then analyzing the attitude of legislation at the international, regional and national levels, to attain the optimal legal reasoning, as well as the legal characterization closest to application; given the jurisprudential theories and comparative judicial rulings, related to criminal responsibility.
