يتناول هذ البحث حديثا من أحاديث السنة، وهو حديث غمس اليد في الإناء، والذي نصه: أن رسول الله- صلى الله عليه وسلم- قال: (إذا استيقظ أحدكم من نومه، فلا يغمس يده في الإناء حتى يغسلها ثلاثا؛ فإنه لا يدري أين باتت يد). وقد تناوله الباحث في تمهيد بين فيه الباحث روايات الحديث التي اعتمدها عليها في بحثه، وبعض الأمور المهمة في تحديد البحث، ثم عقد مبحثين، مبحث تناول فيه مطلبين مطلب في نوع الحكم في الحديث هل هو تعبدي أو معلل، وخلص فيه أنه معلل، وبين ماهية العلة ومسلكها، وفي المطلب الثاني تناول دلالة الأمر والنهي الواردة في روايات الحديث، وانتهى إلى أن دلالة الأمر للاستحباب والنهي للكراهة. ثم عقد الباحث المبحث الثاني في مسائل فقهية ترتبت على نوع الحكم ودلالة الأمر والنهي، وبين فيها من خلال أدلة تلك المسائل كيفية ترتبها وبنائها على نوع الحكم ودلالة الأمر والنهي. ثم ختم الباحث بخاتمة بين فيها أهم النتائج، وفهارس خادمة للبحث.
This study aimed at examining the Hadith which was narrated on dipping hand in the bowl. The study was comprised of a preface, in which the researcher listed all hadith narrations that were investigated herein and the reasons behind selecting this topic. the study included two chapters. The first chapter contained two topics; the first topic discussed whether the ruling identified in the Hadith was devotional or justified and concluded that it was justified, clarifying the justifications behind the ruling. In the second topic the researcher shed some light on the significance of the command and the prohibition contained in Hadith narrations under-study herein and concluded that it is preferable to do so and undesirable to do otherwise. In the second chapter of the study, the researcher discussed the jurisprudential issues that resulted from this type of ruling and the significance of the command and the prohibition contained in the Hadith. Moreover, the researcher identified, through the evidence related to these issues, the relation between them and the ruling as well as the significance of the command and the prohibition contained in the Hadith. Finally, the researcher concluded with a conclusion in which he stated the results of this study and included indexes in relation with the research.
