|a سعت الدراسة إلى بيان حدود انطباق أحكام القانون الدولي الإنساني على إسرائيل ومسئوليتها الدولية في إطار عدوانها الدامي على غزة منذ أكتوبر ۲۰۲۳، والوقوف بشكل واضح على موقف القانون الدولي الإنساني من هذا العدوان، حيث تم التفصيل والتأصيل لماهية القانون الدولي الإنساني ومصادره، ثم تم التعرض الصور الانتهاكات التي قارفها جيش الاحتلال الإسرائيلي في حق الشعب الفلسطيني في غزة والمسؤولية الدولية عن تلك الانتهاكات، مما يعكس لا مبالا من جانب إسرائيل وعدم اكتراثها بحقيقة أنها طرفا في اتفاقية الإبادة الجماعية لعام ۱۹٤٨، والتي تعهدت بموجبها باحترام أحكامها ومراميها في سلوكها الحربي إزاء أي دولة أو إزاء أي جماعة، الأمر الذي يعني أن الاعتماد من قبل إسرائيل على المبررات القانونية والدعاوي الواهية للدفاع عن النفس ومزاعم مكافحة الإرهاب لا يمكن أن توفر أبدا أساسا أخلاقيا أو قانونيا لسلوكها تجاه غزة. وإذا وسعنا نطاق الرؤية إلى ما هو أبعد من تقييم آثار العدوان الإسرائيلي الراهن في غزة، يصبح من الواضح أن إسرائيل قد انتهكت القانون الإنساني الدولي بشكل صارخ منذ مدة طويلة خلال فترة احتلالها الطويلة التي منذ عام ١٩٦٧.
|b The study sought to clarify the limits of the application of the provisions of international humanitarian law to Israel and its international responsibility in the context of its bloody aggression against Gaza since October 2023, and to clearly stand on the position of international humanitarian law on this aggression, where the nature of international humanitarian law and its sources was detailed and consolidated, then pictures were presented. The violations committed by the Israeli occupation army against the Palestinian people in Gaza and the international responsibility for those violations, Which reflects Israel's indifference to the fact that it is a party to the 1948 Genocide Convention, under which it pledged to respect its provisions and objectives in its conduct of war against any country or against any group, which means that reliance by Israel on legal justifications and weak claims for defense Its self-defense and anti-terrorism claims can never provide a moral or legal basis for its behavior towards Gaza. If we broaden the scope of vision beyond assessing the effects of the current Israeli aggression in Gaza, it becomes clear that Israel has long been flagrantly violating international humanitarian law during its long period of occupation since 1967.
