المستخلص: إن من أهم الأحكام الشرعية التي تنظم علاقة الرجل بزوجته ما يتعلق بالطلاق والرجعة، وحيث جاءت الأنظمة الحديثة المرتبطة بتلك الأحكام، والمنظمة لها كنظام الأحوال الشخصية السعودي، ولأهمية هذه الأحكام وأنظمتها الحديثة جاء هذا البحث. وتكمن أهمية هذا الموضوع في حاجة الناس إلى معرفة حكمه، وأهمية نظام الأحوال الشخصية السعودي وكونه صدر حديثا. كما تتلخص إشكالات البحث في الأسئلة التالية: ما صور تعليق الرجعة على شرط؟ وما حكم كل صورة عند الفقهاء؟ ما أدلة الأقوال في كل صورة عند الفقهاء؟ ما الذي اعتمده المنظم السعودي في موضوع الرجعة؟ ويهدف هذ البحث إلى بيان صور تعليق الرجعة على شرط وحكم كل صورة عند الفقهاء، ومناقشة أدلة الأقوال، وبيان ما اعتمده المنظم السعودي من صور الرجعة. وأما حدود هذا البحث فهي صور وأحكام تعليق الرجعة على شرط في الفقه، وحدود هذا البحث من حيث الكتب الفقهية، إضافة إلى نظام الأحوال الشخصية السعودي، الصادر بالمرسوم الملكي رقم (م/ ۷۳) وتاريخ 6/٨/1443هـ. ونتج عن هذا البحث أن الراجح أنه تصح الرجعة المعلقة على شرط في المستقبل، وأن الأحوط عدم تعليق الرجعة على شرط مراعاة القول الجمهور وخروجا من الخلاف، وأن المنظم السعودي اقتصر في نظام الأحوال الشخصية على اعتبار صحة الرجعة المنجزة، وعدم اعتبار المعلقة سواء علقت بشرط أو بزمن.

One of the most important legal provisions that regulate the relationship of a man with his wife is related to divorce and reversion, and where came the modern systems associated with those provisions, and organized them as the Saudi personal status system, and the importance of these provisions and modern systems came this research. The importance of this topic lies in the need for people to know its ruling, the importance of the Saudi personal status system and the fact that it was newly issued. The research problems are summarized in the following questions: What are the forms of commenting on a condition? What is the ruling on each picture according to the jurists? What is the evidence for sayings in each form according to the jurists? What has the Saudi regulator adopted in the matter of reversion? This research aims to clarify the images of the suspension of the return on the condition and rule of each image when the jurists, and discuss the evidence of the statements, and the statement of what was adopted by the Saudi regulator of the images of reversion. The limits of this research are the pictures of the comment of return to the condition, and the limits of this research in terms of books and jurisprudence books, in addition to the Saudi Personal Status Law, issued by Royal Decree No. (M / 73) dated 6/8/1443 AH. This research resulted in the most likely that it is valid to return pending on a condition in the future, and that the precaution not to suspend the return on the condition, taking into account the saying of the public and out of the dispute, and that the Saudi regulator was limited in the personal status system to consider the validity of the completed return, and not to consider the pending, whether suspended on condition or time.
