|a اهتم العلماء بدراسة علم الفروق الفقهية، وتبرز أهميته من خلال إزالة الوهم من الحكم على الأمور المتشابهة بأحكام مختلفة، والحكم على الأمور المختلفة بحكم واحد. وإن من أهم خطوات دراسة الفروق الفقهية هو معرفة موجب الفرق، ومن أهم موجبات الفرق هو موجب النص. جاءت هذه الدراسة لتسلط الضوء على موجب الفرق بالنص، من خلال دراسة ماهيته ونصوص العلماء فيه، ودراسة تطبيقات فقهية عليه. وقد انتظم البحث في مقدمة وثلاثة مباحث، المبحث الأول: التعريف بمصطلحات عنوان البحث. المبحث الثاني: نصوص العلماء في موجب الفرق. المبحث الثالث: تطبيقات موجب الفرق بالنص الفقهية. وقد ختم البحث بنتائج من أهمها: ثبوت التفريق في طريقة تطهير الثوب الذي أصابه بول صبي أو جارية الذي أوجبه ورود النص، وثبوت التفريق بين اعتكاف المرأة في مسجد بيتها، وبين اعتكاف الرجل في المسجد الذي أوجبه ورود النص، وثبوت التفريق بين اعتكاف المرأة في مسجد بيتها، وبين اعتكاف الرجل في المسجد الذي أوجبه ورود النص، وثبوت التفريق بين قسمة العطية بين الأولاد حال الحياة وقسمة الإرث الذي أوجبه ورود النص، وثبوت الفرق بين من يقدم إذا اجتمع الأولياء في درجة للصلاة عليه وغيرها من الصلوات، الذي أوجبه ورود النص.
|b Scholars have been interested in studying the science of jurisprudential differences, and its importance is highlighted by removing the illusion of judging similar matters with different rulings, and judging different matters with one ruling. This study sheds light on the reason for the difference in the text, by studying its nature and the texts of scholars about it, and studying jurisprudential applications on it. The research is organized into an introduction and three sections. The first section: Defining the terms of the research title. Second: Texts of scholars regarding the reason for the difference. Third: Applications of the reason for the difference in the jurisprudential text. The research concluded with results, the most important of which are: Proving the distinction in the method of purifying a garment that has been stained by the urine of a boy or a girl, and the reason for the difference is the presence of the text, proving the distinction between a woman’s seclusion in her home mosque and a man’s seclusion in the mosque, and the reason for the difference is the presence of the text, proving the distinction between a woman’s seclusion in the mosque of her home, and a man’s seclusion in the mosque.
