المستخلص: حقا لقد ترتب على جائحة فيروس كورونا المستجد أزمات صحية غير مسبوقة، امتدت آثارها لتطال الاقتصاد بشكل عام والعلاقات التعاقدية بشكل خاص، ويشكل القانون السلاح الأبرز لمواجهة هذه الآثار. ويناقش هذا البحث الآثار التي تواجهها العلاقات التعاقدية وغير التعاقدية في ظل هذه الجائحة، ولعل أهم الآثار الناتجة عنها تكمن في استحالة تنفيذ بعض الالتزامات وصعوبة تنفيذ الأخرى على النحو المرهق بشكل جسيم، بسبب المرض والإجراءات القسرية المتخذة للحد من انتشاره، وبهذا تعرضنا لأحكام إعمال القوة القاهرة والظروف الطارئة (غير المتوقعة) في مصر وفي فرنسا. ويهدف هذا البحث إلى تحديد الأحكام القانونية المنظمة لآثار هذه الجائحة على العقود المدنية والعلاقات غير التعاقدية وفقا للنظامين القانونين المصري والفرنسي، وذلك من خلال منهج تحليلي مقارن. ولقد أوضحنا بأن المنظومة القانونية في كل من فرنسا ومصر تتضمن مجموعة من الوسائل التشريعية والقضائية الملائمة لمواجهة آثار هذه الجائحة، وعرضنا لشروط إعمال هذه الوسائل، أملا في إرشاد أطراف العلاقات القانونية بما يمكن ترتيبه من اشتراطات بشأن عقودهم المستقبلية لجعلها أكثر تحديدا لمواجهة هذه الأزمات، كالبنود الخاصة بالقوة القاهرة.

Indeed, the emerging Corona Virus pandemic has resulted in unprecedented health crises, the effects of which have extended to the economy in general and contractual relations in particular, and the law is the most prominent weapon to confront these effects. This research discusses the effects that contractual and non-contractual relations face in light of this pandemic, and perhaps the most important effects resulting from it lie in the impossibility of implementing some obligations and the difficulty of implementing others in a seriously stressful manner, due to disease and coercive measures taken to limit its spread, and thus we have exposed the provisions of force majeure and emergency (unexpected) conditions in Egypt and France. This research aims to identify the legal provisions regulating the effects of this pandemic on civil contracts and non-contractual relations in accordance with the Egyptian and French legal systems. This is done through a comparative analytical method. We have made it clear that the legal system in both France and Egypt includes a set of appropriate legislative and judicial means to confront the effects of this pandemic, and we have presented the conditions for the implementation of these means, in the hope of guiding the parties to legal relations with the conditions that can be arranged regarding their future contracts to make them more specific to confront these crises, such as clauses of force majeure.
