|a تعتبر الأسرة نواة المجتمع الأولى؛ لذا فقد خصتها الشريعة الإسلامية بجملة من الأحكام، والقواعد الضابطة لها، وللوقوف على بعض من هذه القواعد تأتي هذه الدراسة في مقدمة ومبحثين لعرض أهم القواعد الفقهية المتعلقة بدليل الاستصحاب، والأحكام الفقهية الأسرية المخرجة عليها، بهدف بيان أهمية هذه القواعد في ضبط أحكام الأسرة، وصيانتها مما يحاك ضدها في هذا العصر، حيث تبين من خلال هذه الدراسة أن الفقهاء استندوا على قواعد الاستصحاب في تخريج العديد من الفروع الفقهية المتعلقة بأحكام الأسرة، خاصة عند تعارض الأدلة، وهو ما أظهر أهمية هذه القواعد في ضبط العلاقات الأسرية وحماية الأسرة في ظل ما أفرزته العولمة والرأسمالية المادية التي غيرت من مفهوم الأسرة، وأفرغتها من القيم الأخلاقية.
|b Family is considered the first nucleus of society. Therefore, Islamic law has designated it with a set of Legal rulings and rules governing it. Aiming to explore some of these rules, this study comes in an introduction and two sections to present the most important jurisprudential rules related to the evidence of "Al'istishab" and the family jurisprudential rulings based on it. The study's main focus is explaining the importance of these rules in controlling the rulings of the family, and preserving it from what is being plotted against it in this era. The study highlights that jurists relied on the rules of "Al'istishab" in extracting many jurisprudential rulings related to the family, especially when there is conflicting evidence, which demonstrated the importance of these rules in governing family relations and protecting the family In the midst of what globalization has produced. This comes in addition to the fact that capitalism has changed the concept of the family, and stripped it of moral value.
