|a تهدف هذه الدراسة إلى جمع المسائل الفقهية التي أخذ بها الإمام مالك رحمه الله في خاصة نفسه وإبرازها، مع دراستها، وقد جاءت الدراسة في مبحثين، المبحث الأول: في التعريف ببعض أصول الاستدلال عند المالكية، وهما مراعاة الاختلاف، والاحتياط، وبيان عمل المالكية بهما، وأما المبحث الثاني فكان في ذكر المسائل الفقهية، وبلغ عددها عشر مسائل، ودرست المسائل بذكر المسألة ودليلها، وذكر المعتمد في المذهب فيها مع بيان دليل المذهب، وذكر ما سطره أئمة المذهب حول المسألة، وظهر من خلال هذه الدراسة شدة تورع الإمام مالك رحمه الله، وعنايته بمبدأ الاحتياط، ومراعاة الاختلاف، والتمسك بما عليه عمل أهل المدينة.
|b This study aims to collect the jurisprudential issues that Imam Malik, may Allah have mercy on him, was reported to have mentioned about himself and highlight them with their study. The study was divided into two sections. The first section introduces some of the principles of inference in the Maliki school, namely consideration of differences, caution, and clarification of the Maliki's work with them. As for the second section, it mentions ten jurisprudential issues, which were studied by mentioning the issue and its evidence, the relied-upon opinion in the school, and the statement of the school's imams about the issue. Through this study, it became apparent that Imam Malik, may Allah have mercy on him, was deeply cautious, attentive to the principle of caution, consideration of differences, and adherence to the practice of the people of Medina.
