|a إن مما يلزم العناية به بيان الاختصاص في الجرائم، والمخالفات والدعاوى الجزائية، فالتأكد من الاختصاص هو أول إجراء شكلي يجب النظر إليه. وحيث إن جرائم البيئة جاءت على خلاف الأصل المتمثل في أن النيابة العامة هي من تتولى النظر في الدعاوى الجزائية، حيث اسند المنظم السعودي الاختصاص في جرائم البيئة ضبطا، وتحقيقا، وإيقاعا للعقوبة لمفتشي وزارة البيئة بموجب نص نظامي خاص، واستثنى صورا بسيطة جعل اختصاصها للنيابة العامة. وهذا التنظيم يرتب آثارا متعددة تتمثل في اختصاص التحقيق والادعاء العام، والاستئناف والنقض، وكذلك بطلان الإجراء أو انعدامه، لذا كان من المهم جدا بيان اختصاصات النيابة العامة في جرائم البيئة، وما يترتب على ذلك من إجراءات، وآثار.
|b One of the things that must be taken care of is clarifying jurisdiction in crimes, violations, and criminal cases. Verifying jurisdiction is the first formal procedure that must be considered. Since environmental crimes are contrary to the principle that the Public Prosecution is the one responsible for examining criminal cases, the Saudi regulator assigned the jurisdiction over environmental crimes in controlling, investigating, and imposing punishment to the inspectors of the Ministry of Environment in accordance with a special regulatory text, and excluded simple cases, making their jurisdiction the Public Prosecution’s jurisdiction. .
