|a هذا البحث الموسوم بـ: "مقاصد الشارع الكلية في التحريم" من البحوث المتعلقة بمقاصد الشريعة، وهو يهدف إلى إبراز مقاصد الشارع من التحريم، وبيان المقصد من هذه الجهة يندر ذكره عند العلماء، حيث أفاد البحث أن مقصد الشارع من هذه الجهة إما أن يكون الصيانة والحماية والإنعام أو الابتلاء، أو العقوبة، ثم بين في البحث كل مقصد من هذه المقاصد وسماته، وكذا بين ما ورد من هذه المقاصد في شرعنا وما لم يرد، ثم أفاد البحث ضابط كل مقصد مع أمثلته، والتي هي -أي الأمثلة- أدلة ومسالك تثبت تلك المقاصد.
|b This research, entitled in:" The General Islamic Law Aims in Prohibition" is one of the researches related to the aims of the Islamic Law and it aims to show the aims of the Islamic Law in creating prohibition as showing this purpose is little at Islamic scholars. The research has shown that the Legislator's purpose of this perspective is either: bestowing favor and benefaction or affliction or punishment. Then it has been shown in the research each aim of these aims and its features, in addition to showing which aims of those aims are found in our Islamic Law and which is not found. At last, the research has shown the regulations of each aim with giving examples, which are regarded as proofs confirming those aims.
