|a يحقق نظام النيابة في التعاقد فوائد عملية كثيرة في مجال المعاملات المدنية وأيضا في الأحوال الشخصية، وذلك بإقامة شخص النائب محل شخص الأصيل والهدف من هذه الدراسة هو معرفة ماهية النيابة قانونا، وأن العبرة فيها بإرادة النائب لا بإرادة الأصيل. لأنه هو المتعاقد مع الطرف الآخر على أن آثار العقد تنصرف إلى الأصيل لا إلى النائب، وأيضا معرفة أهم التشريعات القانونية التي أخذت بهذا الموضوع ونظمت له نصوصا قانونية وكيف نظر الفقه الإسلامي لفكرة النيابة وما هيتها عند فقهاء الشريعة، ومن النتائج المتوصل إليها في هذا البحث أن النيابة في التعاقد في القانون هي نظام أعم بحيث يشمل مفهومها النيابة الاتفاقية وهي الوكالة بالإضافة إلى النيابة القانونية والقضائية وتتمثل في القوامة والوصاية والولاية الشرعية. بينما نجد أن الشريعة الإسلامية أخذت بهذه المواضيع المتضمنة معنى النيابة بشكل مفصل لأحكامها وما يترتب عنها كما أن للنيابة شروط يقتضى للطرفان التعامل بها، وآثار قانونية تعود على الأصيل إلا أن موضوع النيابة في التعاقد يحتاج إلى بعض التعديلات القانونية لاسيما من طرف المشرع الجزائري.
|b The prosecution system in contracting achieves many practical benefits in the field of civil transactions and also personal status. This is done by replacing the person of the representative with the person of the principal. The aim of this study is to know what legal representation is. What matters is the will of the representative, not the will of the principal, because he is the contracting party with the other party, and the effects of the contract go to the principal, not the representative. Also, knowing the most important legal legislation that took up this issue and organized legal texts for it, and how Islamic jurisprudence viewed the idea of representation and what it is according to Sharia jurists. Among the results reached in this research is that representation in contracting in law is a more general system in that its concept includes representational an agreement, which is the agency in addition to the legal and judicial representation, which is represented in guardianship, guardianship, and legal guardianship. While we find that Islamic law has taken into account these topics, which include the meaning of representation in a detailed manner regarding its rulings and their consequences, and representation has conditions that require both parties to deal with them and legal effects that affect the principal, the issue of representation in contracting needs some legal amendments, especially by the Algerian legislator.
