|a لا يخفى على القارئ الكريم أن من أهم الوظائف التي يقوم بها قاضي التنفيذ بيع مال المدين، وتقسيم حصيلته على الدائنين. وهذه الوظيفة الحساسة لقضاء التنفيذ تحتاج إلى إجراءات كثيرة ومتعددة؛ سعيا منه نحو تحقيق أفضل نتيجة ممكنة تصب في مصلحة الدائنين والمدين. لذلك سعى المنظم إلى إشراك القطاع الخاص في بعض أعمال قضاء التنفيذ؛ للمساهمة في سرعة الخدمة المقدمة وجودتها. ومن ضمن مقدمي الخدمات: وكيل البيع القضائي، وهو من تقع عليه مسؤولية ما تتطلبه عملية البيع من مزادات، وتسويق، وإعلان؛ للبحث عن المشتري الأنسب. ويركز هذا البحث في التعرف على طبيعته النظامية، والتكييف الفقهي له، ومعرفة الحقوق المقررة له. حيث توصلت إلى أن طبيعته النظامية تتمحور في اعتباره تابعا لوكيل التنفيذ، ويكون تحت إشرافه. إلا أنه لا يكتسب صفة الوظيفة العامة كمأمور التنفيذ، بل يخضع لإشراف وزارة العدل، ويلتزم بما ورد في لائحة مقدمي خدمات التنفيذ من ضوابط والتزامات. وتكييفه في الفقه الإسلامي لم يخرج عن أهل الخبرة الذين يستعين بهم القاضي في عمله. وله مجموعة من الحقوق المقررة. فما هي طبيعته النظامية؟ وما هي حقوقه نظاما وفقها؟ سنجد الإجابة- بإذن الله- في هذا البحث المتواضع، والذي جعلته تحت عنوان: وكيل البيع القضائي طبيعته وحقوقه في النظام السعودي والفقه الإسلامي.
|b It is clear to the reader that one of the most important roles of the execution judge is to sell the debtor’s money and divide it among the creditors. This sensitive role of the execution judiciary needs many and multiple procedures. In an effort to achieve the best possible result in the interest of the creditors and the debtor. Therefore, the judiciary system sought to involve the private sector in the execution process; to contribute to the speed and quality of service provided. Among the service providers: the judicial sales agent, who is responsible for the auctions, marketing and advertising required by the sale process; to find the most suitable buyer. This research focuses on identifying its systematic nature, its jurisprudential description, and knowing the rights established for it. Where I concluded that his systematic nature revolves around considering him subordinate to the execution officer and under his supervision. However, he does not have the status of a public office as an execution officer, but is subject to the supervision of the Ministry of Justice, and adheres to the controls and obligations contained in the list of execution service providers. And its description in Islamic jurisprudence did not deviate from the people of experience whom the judge relies on in his work. And he has a set of established rights. What is its systematic nature? And what are his rights according to the system and jurisprudence? We will find the answer – Allah willing- in this modest research, which I made under the title: The Judicial Sales Agent: His Nature and Rights in the Saudi System and Islamic Jurisprudence.
