|a تعد الحياة السياسية وما يعتريها من مشاركة وما يكتنفها من صراع الميزان الذي توزن به الأنظمة، على اعتبار أن المشاركة في الحياة السياسية تعتبر معيارا حقيقيا لقياس مدى ديمقراطيتها وأوجهتها، فديمقراطيته مرتبطة ارتباطا وثيقا بالحقوق والحريات السياسية والفكرية، وضياع هذه الأخيرة هو هدر لمعاني وقيم كثيرة في حياة الأفراد، فالاستبداد السياسي وأحادية الرؤية والاستئثار السلبي بالسلطة، وعدم تغليب سلطة الشعب، يغطي على معظم مظاهر الحياة ويفقدها معناها، ولأن حقوق الإنسان وحرياته الأساسية مرهونة بشخصه، وأن كمال الإنسانية ومثالياتها مرهونة بما يمثله الإنسان من قيمة راسخة في منظومة نظام الحكم وسيرورته، كان فيها المرفق العام أحد أهم ركائزه ومشتملاته، مما أوجب خلق بيئة إنسانية وسياسية صحية يقوم فيها الموظف العام بممارسة حرياته السياسية كمتنفس، وهو ما خلق الكثير من الجدل الفقهي والقضائي حول موقف التشريعات من حق الموظف العام في المشاركة السياسية، ومدى إمكانية مباشرة الرقابة التشريعية المسبقة عليها.

Political tyranny, unilateral vision, negative monopolization of power, and failure to give priority to the power of the people obscure most aspects of life and make them lose their meaning. Because human rights and basic freedoms depend on his person, and the perfection of humanity and its ideals depend on the value that man represents, rooted in the system of government and its process, it was the public facility is one of its most important pillars and components, which necessitated the creation of a healthy humanitarian and political environment in which the public employee can exercise his political freedoms as an outlet. This has created a lot of jurisprudential and judicial controversy over the position of legislation on the public employee's right to political participation, and the extent of the possibility of directing prior legislative oversight over it.
