المستخلص: لقد أصبحت مقاصد الشريعة في العصر الحديث علما مستقلا متميزا عن غيره من العلوم الشرعية، بعد أن نضجت مبادئها وقواعدها ومباحثها وموضوعاتها في أيدي فحول العلماء المعاصرين الذين قدموا خدمة علمية عالية في إحياء مقاصد الشريعة وتطويرها. يهدف هذا البحث إلى رصد وبيان الأفكار المقاصدية التأسيسية لأحد رموز هذا العلم وأعلامه الكبار في هذا العصر، وهو العلامة الشيخ الدكتور أحمد الريسوني المغربي، الذي ساهم بشكل كبير في الحقل المقاصدي المعاصر تدريسا وتأصيلا وتطبيقا. لا يكتفي الريسوني بدعوة إلى الاهتمام بمقاصد الشريعة والالتفات إليها في الاجتهاد الفقهي فحسب، بل قدم كثيرا من الآراء المركزية والأفكار التأسيسية التي تجلي حقيقة مقاصد الشريعة ومكانتها، وتؤطر العمل بها واستثمارها في فهم النصوص وتطبيقها، وتوجه الاجتهاد المقاصدي المعاصر إلى الطريق المنضبط علميا والمسار الصحيح شرعيا. ينتهج الباحث المنهج التحليلي باستقراء أفكار مقاصدية رئيسية للريسوتي، التي طرحها وأصلها وأكد عليها في مؤلفاته وإنتاجاته العلمية. لقد توصل البحث إلى بعض أفكار مقاصدية تأسيسية -وربما تجديدية- قام الريسوني بتأصيلها وتوضيحها وتأكيد عليها، منها: الفكر المقاصدي، والاجتهاد المقاصدي والتعليل المصلحي المقاصدي، ومنهجية الاجتهاد التنزيلي المكون من: النصوص والمقاصد والواقع، وتقعيد القواعد المقاصدية.

Maqashid sharia has transformed into an independent scientific discipline through some developments from late scholars. They took part in constructing the concept of maqashid sharia, outlining the epistemological foundation and the mechanism of its implementation. This research aims to examine the basis of the thoughts and ideas of Ahmad Ar-Raisuni, one of the central figures of contemporary maqashid sharia. Ar-Raisuni has made a great contribution to the maqashid of sharia both academically, theoretically, and practically. Ar-Raisuni not only called for the actualization of maqashid sharia in the construction and formulation of fiqh, but also prioritized the basic thoughts and ideas of the concept of maqashid sharia, actualized the maqashid approach in ijtihad, and formulated the scientific methodology of fiqh with the maqashid approach. This article employs a qualitative approach by exploring the main ideas of Ar-Raisuni in his works. This research concludes some of Ar-Raisuni's principal thoughts: the style of maqashid sharia thought, ijtihad based on the maqashid approach, analysis of objectives and orientation to the benefit of law, and the development of a law enforcement methodology that collaborates: text, purpose and reality, as well as formulating the principles of maqashid sharia.

Maqashid syariah telah menjelma menjadi disiplin keilmuan yang mandiri melalui ijtihad dari para ulama masa kini. Mereka turut andil dalam mengkonstruksi konsep maqashid syariah, menguraikan landasan epistemologis dan mekanisme pelaksanaannya. Penelitian ini bertujuan untuk mengkaji dasar pemikiran dan gagasan maqashid syariah Ahmad Ar-Raisuni, salah satu tokoh sentral maqashid syariah kontemporer. Ar-Raisuni telah memberikan kontribusi besar terhadap maqashid syariah, baik secara akademis, teoritis, dan praktis. Ar-Raisuni tidak hanya menyerukan aktualisasi maqashid syariah dalam konstruksi dan perumusan fiqh saja, tetapi juga mengedepankan pemikiran dan gagasan mendasar konsep maqashid syariah, mengaktualisasikan pendekatan maqashid dalam ijtihad, dan merumuskan metodologi keilmuan fiqh, pendekatan maqashid. Penulis menggunakan pendekatan kualitatif dengan menggali pokok pikiran dan gagasan Ar-Raisuni dalam tulisan dan karya ilmiahnya. Penelitian ini menyimpulkan beberapa pokok pemikiran Ar-Raisuni: gaya pemikiran maqashid syariah, ijtihad berdasarkan pendekatan maqashid, analisis tujuan dan orientasi kemaslahatan hukum, dan pengembangan metodologi penegakan hukum yang mengkolaborasikan: teks, tujuan. dan kenyataan, serta merumuskan prinsip-prinsip maqashid syariah.
