|a تتمحور الدراسة أساسا حول استهداف المحتل الفرنسي للقضاء الإسلامي وفق مخطط ممنهج ارتكز على آليات ووسائل قانونية جائرة وممارسات تعسفية، كونه كان يرى أن القضاء هو الوجه الآخر للدين الإسلامي، المكون الأساسي للهوية الوطنية إضافة إلى اللغة العربية، فالإبقاء على نشاطه كان سيشكل عقبة كأداء في وجه مخطط المسخ الاستعماري الصليبي بالجزائر، لذلك لم تتوان جمعية العلماء المسلمين الجزائريين في مجابهته باستبسال منقطع النظير، متخذة وسائل نضالية متعددة، وكانت الصحافة أكثرها فعالية، نجد في مقدمتها جريدة البصائر (1935-1956) التي أبلت البلاء الحسن في سبيل فرض وجود القضاء الإسلامي الجزائري واستقلاليته عن الدولة الفرنسية.
