|a هذه الدارسة جاءت بعنوان: "الفتوى والقضاء عند الإمام محمد بن عبد الكريم المغيلي (توفي: 909هـ- 1504م) من خلال مدونته نازلة يهود توات"، والتي تهدف إلى إعطاء نظرة تاريخية عن وضع الفتوى والقضاء نهاية العصر الوسيط في إقليم توات الصحراوي، كما سنعرج في هذه الورقة البحثية إلى أوضاع المغرب الأوسط نهاية العصر الوسيط، التي ساهمت في تنامي الوجود اليهودي، وقصور جهاز القضاء في قصور الصحراء لنؤكد في الأخير على دور الإمام المغيلي الإصلاحي في محاربة الفساد؛ من خلال تطبيق الحدود مع أهل الذمة والتدرج في مؤسسات القضاء، وتنظيمها، من توليه منصب قاضي الجماعة، إلى منصب والي الحسبة، زيادة عن ذلك، أنه أضاف الجهاز القضاء وظائف جديدة أكثر دقة وحيوية.
|b This study is entitled: "The advisory opinion and the judiciary of Imam Mohamed bin Abdul Karim Al-Maghili (d: 909 AH 1504 m) through his anti-Jewish Tuat blog," which aims to give a historical view of the status of the advisory opinion and the end of the intermediate era in the Saharan Tawat region. In this research paper, we will refer to the situation of the Middle Morocco, which has contributed to the growth of the Jewish presence and to the shortage of the judiciary in the desert. Finally, let us emphasize the role of the reformist imam and the fight against corruption. In the institutions and organization of the judiciary, from serving as Community Judge to serving as Governor, the judiciary has added new, more precise and dynamic functions.
