|a قد فطن المشرع لسلوكيات الكذب المجرد الذي يرتكبه البعض للإيهام بأنه ينتمي لوظيفة مرموقة، أو أنه يحمل الأوسمة والنياشين السامية، أو أنه يسمى بلقب من ألقاب الشرف والرتب، فيقوم لتحقيق ذلك بالتداخل في الوظائف العامة، أو إجراء عمل من مقتضياتها، أو يقوم بلبس زي رسمي خاص بوظيفة أو رتبة معينة، أو يعلق علامة مميزة لهذه الوظيفة بدون وجه حق، أو يلقب نفسه بلقب أو صفة نيابية عامة وكل هذه السلوكيات يرتكبها الفاعل بغرض تحقيق منفعة معنوية أو أدبية تتمثل في التباهي والتفاخر لسد نقص في نفسيته، بدون أن يتحقق له أي منفعة مادية أو مالية من وراء ذلك، وإلا تحققت بأفعاله جريمة النصب. ولا شك أن هذه التصرفات تحط من قدر الوظائف الحكومية وتقلل من قدر الأوسمة والنياشين، مما يهدد المصلحة العامة، وهو ما حدا بالمشرع لتجريم هذه الأفعال وعاقب عليها بعقوبة الحبس أو الغرامة المالية.
