|a غاية القضاء فصل الخصومة بإيصال الحق لصاحبه ومنع التعرض إليه إذا تبين أنه غير محق في طلبه، وسبيل ذلك طرح النزاع للقضاء، فإذا أصدر القضاء حكما وهو الحل المنهي للخصومة بين الخصوم ومرت جميع مراحل الطعن أصبح الحكم قطعيا ويطلق عليه بالتمسك بحجية الأمر المقضي به أي الجاهز للتنفيذ، ويشترط للتمسك بدفع حجية الأمر المقضي اتحاد السبب والموضوع والأشخاص، وهذا الدفع دفع حق عام تتعرض له المحكمة والخصوم وبأي مرحلة من مراحل الدعوى.

The only way to do that is to submit the matter to the judiciary. If the judiciary issues a ruling, which is the final solution to the dispute between the opponents, and passes through all the stages of appeal, even if there is no room left for appeal, its name becomes authoritative of the res judicata. Ready for implementation. To uphold the validity of a res judicata, it is required that the reason, subject, and persons be united. This defense is a defense of a general right to which the court and the opponents are exposed, at any stage of the case.
