|a تضمن مشروع القانون رقم 02.23 المتعلق بالمسطرة المدنية، مجموعة من المستجدات التشريعية والتعديلات الهامة كتجميع شتات المساطر المدنية والإدارية والتجارية، وتلك المتعلقة بقضاء القرب والاستناد إلى مبدأي وحدة القضاء والتخصص فيه، والضبط القانوني للمقتضيات المتعلقة بالاختصاص القضائي الدولي، وكذا اعتماده على وسائل التكنولوجيا الحديثة في إجراءات التقاضي، ثم مراعاة المستجدات التشريعية ذات الصلة؛ غير أنه أثار جدلا حادا حول مجموعة من مقتضياته، خاصة ما يتعلق بمخالفة جزء منها لأحكام الدستور أو مسها باستقرار المنظومة القانونية والأمن القضائي للبلاد، أو ما سجل من تراجع عن المكتسبات الحقوقية. فهل تمكن هذا المشروع من تجاوز الإشكالات التي أبانت عنها الممارسة العملية على مدى نصف قرن على اعتماد القانون الجاري؟ وهل راعت المقتضيات التي اعتمدها تلك الحقوق التي أقرها دستور 2011 وكرستها القوانين والاجتهادات القضائية؟
|b The Draft Law No. 02.23 on Civil Procedure includes a range of legislative innovations and significant amendments. These include the consolidation of various civil, administrative, and commercial procedures, as well as those related to proximity courts. It is based on the principles of judicial unity and specialization, the legal regulation of international jurisdiction provisions, and the use of modern technology in legal proceedings. It also takes into account recent legislative developments. However, the draft has sparked intense debate over several of its provisions, particularly concerning their compliance with the constitution, their impact on the stability of the legal system and judicial security of the country, and perceived setbacks in human rights achievements. Has this draft managed to address the issues highlighted by practical experience over the past fifty years? And have the provisions it adopts respected the rights established by the 2011 Constitution and reinforced by laws and judicial interpretations?
