|a تسهر الدولة الحديثة على حماية الحقوق والحريات من خلال تضمينها في الدساتير وتكريسها في مختلف القوانين، ويعد مبدأ المساواة الأرضية التي تبنى عليها الحقوق والحريات بمختلف أنواعها، إذ لا يخلو دستور حديث من النص على هذا المبدأ باعتباره الطريق الأصوب لصيانة الحقوق والحريات. وإذا كانت المجتمعات والدول تصنف اليوم بمدى احترامها للحقوق والحريات فإن كل ذلك يبقى مجرد شعارات ما لم يجسد مبدأ المساواة في المنظومة القانونية أولا، وتكريسه في كل الممارسات ثانيا.
|b The modern state protects rights and freedoms by incorporating them in constitutions and enshrining them in various legislations and laws. The principle of equality constitutes a solid ground on which rights and freedoms of all kinds are built, as a modern constitution is not free of providing for this principle as the best way to safeguard rights and freedoms. If societies and States are classified today as respect for rights and freedoms, all of this remains mere slogans unless it embodies the principle of equality in the legal system first, and is enshrined in all practices secondly.
