|a تتناول هذه الدراسة بالبيان موضوعاً في غاية الأهمية والمتعلق بالتعديلات الحديثة التي أدخلها المشرع الإماراتي على قانون الإجراءات المدنية، والتي قام من خلالها بإيجاد محكمة خاصة غير مسبوقة أسماها بالمحكمة الخاصة التي قرر لها أحكاماً تجعل منها درجةً واحدةً للتقاضي، وقد سعت الدراسة إلى بيان الأحكام التي قررها المشرع لهذه المحكمة. كما سعت الدراسة إلى تقييم ما قرره المشرع بخصوص هذه المحكمة، ولاسيما في ظل مبدأ التقاضي على درجتين، وصولاً إلى الوقوف على أي اختلالات وردت في التنظيم المقرر، وقد تبنت الدراسة توصيات عديدة من شأنها إذا ما أخذ بها أن تؤدي إلى رفع سوية التنظيم القائم والوصول به إلى درجة أعلى من العدالة.
|b This study deals with a very important topic related to the recent amendments made by the Emirati legislator to the Civil Procedures Law, where, through which he created an unprecedented new court, which he calls as 'the Special Court'. In his newly adopted regulation, the law makes this court a court of one level of litigation. The study sought to analyse the newly introduced regulation in this regard. The study also seeks to evaluate the legislator's adopted rules regarding this court, both in general and under the principle of two-court's level litigation, so that any imbalances or defects may be detected and marked. The study adopts more than recommendation, if taken into account, a higher level of justice will be achieved regarding the points in question.
