|a إن العالم اليوم بأسره يسعى جاهدا نحو تحقيق إدارة إلكترونية، نتيجة للثورة التكنولوجية التي عرفتها أغلب الدول، ومواكبة هذا التطور يحقق السرعة في تقديم الخدمات بالشكل الإلكتروني في شتى مجالات الحياة بما في ذلك قطاع العدالة الذي يحتاج لتلك الخدمات الإلكترونية، باعتباره قطاع حيوي يقف على حماية حقوق وحريات الأفراد، ولكي يؤدي هذا المرفق وظيفته على أحسن وجه لابد من تقريبه للمواطن وتبسيط إجراءات اللجوء إليه من أجل ضمان السرعة والجودة في تقديم خدماته. ولقد أولت الجزائر أهمية بالغة لهذا القطاع، إذ أنها تسعى لوضع الركائز الأساسية للتقاضي إلكتروني، والانتقال من النظام الورقي التقليدي إلى النظام الإلكتروني لأن مبتغاها الاستفادة من كل المزايا التي تحققها رقمنة قطاع العدالة. وعليه سنخصص هذه الورقة البحثية لدراسة التقاضي الإلكتروني أمام القضاء الإداري في الجزائر من خلال قانون الإجراءات المدنية والإدارية الجزائري المعدل والمتمم وقوانين أخرى ذات الصلة.
|b The whole world today is striving to achieve electronic management, as a result of the technological revolution that most countries have known, and to keep pace with this development, it achieves speed in providing services in electronic form in various fields of life, including the justice sector, which needs these electronic services, as a vital sector that stands on protecting the rights and freedoms of individuals, and in order for this facility to perform its function in the best way, it must be brought closer to the citizen and simplify the procedures for resorting to it in order to ensure speed and quality in providing its services. Algeria has attached great importance to this sector, as it seeks to lay the basic foundations for electronic litigation, and to move from the traditional paper-based system to the electronic system because it wants to take advantage of all the advantages achieved by the digitization of the justice sector. Accordingly, we will devote this research paper to the study of electronic litigation before the administrative judiciary in Algeria through the amended and supplemented Algerian code of civil and Administrative Procedure and other relevant laws.
