المستخلص: جاء البحث الحالي للحديث عن فكرة الإلزام بالقاعدة القانونية من الموضوعات الهامة التي شغلت الكثير من أهل العلم القانوني، ولاسيما القواعد القانونية التي تنظم حياة الأفراد وتعاملاتها سواء على مستوى القانون المدني أو القانون الجنائي، ونطاق تطبيق تلك القواعد، فقد تناولنا في هذا البحث مفهوم الإلزام في القاعدة القانونية كمبحث أول وقسمنها إلى مطلبين، الأول خصصناه للخاصية الحمائية للقاعدة القانونية وفكرة الحقوق الفردية، والمطلب الثاني تناولنا فيه فكرة قاعدة السلوك الاجتماعي للقاعدة القانونية، ثم تناولنا في المبحث الثاني أساس إلزامية القاعدة القانونية وقسمناه إلى مطلبين، المطلب الأول عن المدلول القانوني للأحداث ومحور نظرية القانون، والمطلب الثاني عن فكرة إلزام القاعدة القانونية وارتباطها بالتكليف، ثم المبحث الثالث، والمعنون قاعدة الاعتذار بجهل القانون وعلاقته بفكرة الإلزام وقسمناه إلى ثلاثة مطالب، المطلب الأول خصصناه بقاعدة عدم جواز الاعتذار بجهل القانون، والمطلب الثاني تناولنا فيه الاعتذار بجهل القانون والحكم التكليفي، والمطلب الثالث جعلناه عن الاعتذار بجهل القانون والتصرف القانوني، وأخيرا المبحث الرابع وعنوناها إلزامية القاعدة القانونية والآثار القانونية، والذي قسمنا إلى مطلبين الأول عن إلزامية القاعدة القانونية والعقل الإرادي وآثاره، والمطلب الثاني عن إلزامية القاعدة القانونية والضرر ثم ختمنا البحث بخاتمة لخصنا كل ما سبق أن تناولناه فيه.

The current research came to talk about the idea of obligation by the legal rule from the important topics that occupied many legal scholars, especially the legal rules that regulate the lives of individuals and their dealings, whether at the level of civil law or criminal law, and the scope of application of those rules. In this research, we addressed the concept of obligation in the legal rule as a first topic and divided it into two requirements. The first was devoted to the protective characteristic of the legal rule and the idea of individual rights. The second requirement addressed the idea of the rule of social behavior of the legal rule. Then, in the second topic, we addressed the basis of the obligation of the legal rule and divided it into two requirements. The first requirement is about the legal meaning of events and the axis of the theory of law. The second requirement is about the idea of obligation of the legal rule and its connection to the assignment. Then, the third topic, entitled the rule of apology for ignorance of the law and its relationship to the idea of obligation, and we divided it into three requirements. The first requirement was devoted to the rule of inadmissibility of apology for ignorance of the law. The second requirement addressed apology for ignorance of the law and the obligatory ruling. The third requirement was about apology for ignorance of the law and legal action. Finally, the fourth topic. We entitled it the obligation of the legal rule and the legal effects, which we divided into two sections: the first on the obligation of the legal rule and the voluntary mind and its effects, and the second section on the obligation of the legal rule and harm. Then we concluded the research with a conclusion in which we summarized everything we had previously discussed in it.
