المستخلص: يهدف البحث إلى التعرف على مفهوم الضمان، والشركة، ودراسة الجدوى، ثم بيان التأصيل الشرعي لدراسة الجدوى، ويهدف البحث أيضا إلى تكييف الجهات المستقلة المعدة لدراسات الجدوى بالأجير المشترك، وعلى من يقع عليه عبء الإثبات؟ وقد اعتمدت في البحث على المنهج الاستقرائي والتحليلي، وكذلك المنهج المقارن، وقد اقتضت طبيعة هذا البحث أن أقسمه إلى مقدمة، وثلاثة مباحث وخاتمة، أما المقدمة فقد تناولت فيها أهمية الموضوع، وأسباب اختياره، ومشكلة البحث، والدراسات السابقة، وبيان منهج البحث، وخطة البحث. ثم انتقلت إلى الحديث عن المبحث الأول، والذي تناولت فيه التعريف بمصطلحات البحث. ثم تكلمت بعد ذلك عن المبحث الثاني، والذي تحدثت فيه عن التأصيل الشرعي لدراسة الجدوى. ثم انتقلت إلى الحديث عن المبحث الثالث، والذي تناولت فيه حكم ضمان الجهات المستقلة المعدة لدراسات الجدوى لنتائج دراستها. ثم انتهيت بعمل خاتمة للبحث، والتي تشتمل على أهم النتائج والتوصيات التي أمكن التوصل إليها. وقد توصلت من خلال هذا البحث إلى عدة نتائج، منها: أن الجهات المستقلة المعدة لدراسات الجدوى ينطبق عليها أحكام الأجير المشترك؛ لذلك تأخذ أحكام الأجير المشترك من حيث الضمان وعدمه. كما توصلت من خلال هذا البحث إلى عدة توصيات، منها: أن يدرج بند في العقود التي تبرم بين الجهات المعدة لدراسات الجدوى وبين الجهات المعدة لهم، ينص على التزام الجهات المعدة لدراسات الجدوى بالضمان عند تخلف نتائج دراسة الجدوى، وأن تكون الجهات المعدة لهم دراسات الجدوى مسؤولة عن إثبات أن تخلف النتائج يرجع للدراسة.

The research aims to identify the concept of guarantee, the company, and the feasibility study, then explain the legal basis of the feasibility study. The research also aims to adapt the independent bodies preparing feasibility studies to the joint wage, and on whom does the burden of proof fall? In the research, I relied on the inductive and analytical approach, as well as the comparative approach. The nature of this research required that I divide it into an introduction, three sections, and a conclusion. As for the introduction, I addressed the importance of the topic, the reasons for choosing it, the research problem, previous studies, and an explanation of the research methodology and its steps. And the research plan. Then I moved on to talk about the first topic, in which I discussed the definition of search terms. Then I talked about the second topic, in which I talked about the legal foundation of the feasibility study. Then I moved on to talk about the third section, in which I discussed the ruling on independent bodies preparing feasibility studies guaranteeing the results of their studies. Then I finished by writing a conclusion for the research, which includes the most important results and recommendations that could be reached. Through this research, I reached several results, including: The independent entities preparing feasibility studies are subject to the provisions of joint rent; Therefore, the provisions of the joint employee are taken into account in terms of guarantee or lack thereof. Through this research, I also reached several recommendations, including: that a clause be included in the contracts concluded between the entities preparing the feasibility studies and the entities preparing them, stipulating: the obligation of the entities preparing the feasibility studies to guarantee when the results of the feasibility study fail, and that the entities preparing studies for them be Feasibility is responsible for proving that the results are not due to the study.
