|a يهدف هذا البحث إلى إيضاح المقاصد الجزئية في قطع يد السارق، وما يتعلق بهذا الحكم من نوازل مستجدة ومسائل معاصرة. وقد تضمن البحث في طياته مقدمة، وثلاثة مباحث، وخاتمة، ففي المقدمة تمهيد للموضوع، وفي المبحث الأول: التعريف بأهم مفردات العنوان، وفي الثاني: مقاصد الشرعية الجزئية في عقوبة قطع يد السارق، وفي الثالث: استعمال البنج في قطع يد السارق، وفي الخاتمة ذكر أبرز التوصيات. ومن أبرز أهداف في هذا البحث: 1-معرفة غايات وحكم الحدود الشرعية، وبيانها لدى القضاة والفقهاء والأطباء وعموم الناس. 2-ربط المقاصد الشرعية بالنوازل الفقهية؛ لتحقيق التوازن في الأحكام، والقدرة على معرفة تنزيلها على الوقائع المستجدة. 3-الرد على شبه المفترين، الذين يلمزون الشريعة بالجمود والقصور وعدم وفائها بمتطلبات العصر وحاجات الناس. ومن أهم توصيات البحث: 1-دعوة لوضع مؤسسات تشريعية ورقابية مشتركة بين أهل العلم والأطباء، ووضع ضوابط لمنع المتلاعبين والدخلاء من الإساءة لمهنة الطب. 2-الحث على ترجمة بعض المصطلحات الطبية التي يحتاجها العلماء في دراستهم.

Mention the most important recommendations The most important objectives of this research are 1- Knowing the purposes and rules of legal limits, and explaining them to judges, jurists, doctors, and the general public 2- Linking Sharia objectives to jurisprudential issues; To achieve balance in judgments, and the ability to know and apply them to emerging facts 3- Responding to the quasi-slanderers, who accuse Sharia of stagnation, shortcomings, and failure to meet the requirements of the times and the needs of the people Among the most important recommendations of the research: a call to establish joint legislative and oversight institutions between scholars and doctors, and to establish controls to prevent manipulators and outsiders from abusing the medical profession.
