المستخلص: تواجه عملية استنباط الأحكام الشرعية من النصوص الشرعية تحديات عديدة، منها تعارض النصوص ظاهرا، ويهدف هذا البحث إلى دراسة كيفية الترجيح بين الأخبار المتعارضة ظاهرا في السنة النبوية من خلال منهج المقاصد الشرعية؛ حيث يمكن تطبيق نتائج هذا البحث على مختلف مجالات الفقه الإسلامي، كما يمكن للفقيه الأصولي وغيره أن يستخدم قواعد الترجيح بالمقاصد الشرعية عند تعارض النصوص ظاهرا، كما يمكن تطبيق هذه القواعد على قضايا العصر الحاضر؛ حيث يمكن للفقيه أن يستخدمها لاستنباط الأحكام الشرعية الجديدة التي تتوافق مع مقاصد الشريعة الإسلامية، وقد قمت أثناء الكتابة في هذا البحث باستخدام المنهج الاستقرائي والمنهج الوصفي التحليلي لدراسة الموضوع وذلك عند جمع وتحليل النصوص المتعارضة ظاهرا في السنة النبوية، ثم قمت بتطبيق قواعد الترجيح بالمقاصد الشرعية على هذه النصوص، وقد توصل الباحث إلى أن الترجيح بالمقاصد الشرعية بين الأخبار المتعارضة في السنة النبوية هو أداة فاعلة لمعرفة الأحكام الشرعية الصحيحة، كما أن قواعد الترجيح بالمقاصد الشرعية تبنى على أساس تحقيق المصالح ودفع المفاسد، وأن هذه القواعد تراعي سياق النصوص وظروف نزولها.

The process of deriving Shari'a rulings from Shari'a texts faces many challenges, including the apparent conflict of texts, and this research aims to study how to weighting between apparently conflicting news in the Sunnah of the Prophet through the approach of Shari'a objectives; where the results of this research can be applied to various fields of Islamic jurisprudence, and the fundamentalist jurist and others can use the rules of weighting based on objectives of Islamic Shari'a when texts appear to conflict. These rules can also be applied to the issues of the present era, where the jurist can use them to derive new Sharia provisions that correspond to the objectives of Islamic law, and while writing in this research, I used the inductive method and descriptive analytical method to study the subject, when collecting and analyzing the apparently conflicting texts in the Sunnah of the prophet, and then I applied the rules of weighting based on objectives of Islamic Shari'a to these texts. The researcher also concluded that the rules of weighting with objectives of Islamic Shari'a between the conflicting news appearing in the Sunnah of the prophet is an effective tool to know the correct sharia rulings, and the researcher also concluded that the rules of weighting with objectives of Islamic Shari'a are built on the basis of achieving interests and paying off corruptions, and that these rules take into account the context of the texts and the conditions of their transmission.
