|a يهدف البحث ممارسة الحق بلا قيد والاختيار بإرادة تامة بين استيفائه، والتنازل عنه هو معنى الحرية الناشئة من الحق والحقوق في باب الأحوال الشخصية كثيرة، وقد راعتها الشريعة، وأقرت حرية الممارسة فيها؛ ومن هذه الحريات في ممارسة الحقوق ما يثبت لكلا الزوجين، ومنها ما يختص به أحدهما؛ وقد عنيت في هذا البحث بدراسة نماذج منها، وفق منهج تحليلي استقرائي لاستظهار الأمثلة الدالة عليها، ووسمته بـ (الحرية في ممارسة الحقوق الزوجية- دراسة نماذجية فقهية)، وكان من نتائج هذا البحث أن الحرية هي ممارسة الحق بلا قيد، وأن الحق هو منشأ الحرية، الذي تنطلق منه ومن توصياته استكمال جمع ودراسة المسائل التي ذكر فيها الفقهاء حرية الممارسة للحق في أبواب الأحوال الشخصية، وبقية الأبواب الفقهية.
|b Exercising the right without restriction and choosing with complete will between fulfilling it and giving it up, is the meaning of freedom arising from the right. The rights in the field of personal status are many, and the Sharia has protected them and approved the freedom to exercise them. Among these freedoms in exercising rights are those granted to both spouses, and others are specific to one of them. In this research, I focused on studying examples of them, according to an inductive analytical approach to show examples that indicate them, and I labeled it as the (freedom to exercise marital rights - a typical jurisprudential study).. The results of this research included that freedom is the exercise of the right without restriction, and that the right is the source of freedom. Among recommendations: completing the collection and study of the issues in which jurists mentioned the freedom to exercise the right in the personal status chapters and the rest of the jurisprudential chapters.
