المستخلص: إن الرخص الشرعية ودراستها دراسة تطبيقية على أي القرآن الكريم والسنة النبوية من المباحث الجلية النفع، وله من الأهمية في التشريع والأحكام والتطبيق العلمي، وقد اهتمت هذه الدراسة بتطبيق الرخص الشرعية على القرآن والسنة، فقمت بدراسة الرخص وما يتعلق بها من دراسة أصولية، اعتمدت فيها على أمهات الكتب، وإبراز الجانب التطبيقي وربطه بالجانب الأصولي حيث إنه الغاية من هذه الدراسة. وقد قمت بتقسيم البحث إلى مقدمة، وتمهيد، ومبحثين، وخاتمة، وفهارس. ففي التمهيد: قمت بتقسيم الحكم الوضعي إلى عزيمة ورخصة، وقمت بتعريف العزيمة، وأقسامها، وتعريف الرخص الشرعية، وأقسامها، وأسبابها، وضوابطها، وأدلة ثبوتها، وفي المبحث الأول: قمت بتطبيق الرخص الشرعية على القرآن الكريم، وفي الثاني: بتطبيقها على السنة النبوية، مبينة الفروع الفقهية ودراسة أقوال الفقهاء فيها، وأدلتهم، والترجيح بينها، وربط ذلك بالجانب الأصولي، وبيان مدى يسر الشريعة الإسلامية وسهولتها ومراعاتها أحوال المكلفين في يسرهم وعسرهم، وخاصة في هذا الوقت التي كثرت فيه الحوادث والمستجدات، وأنها باقية وخالدة وصالحة لكل زمان ومكان.

The legal licenses and their applied study on the Holy Qur’an and the Sunnah of the Prophet are clearly beneficial topics, and have importance in legislation, rulings, and scientific application. This study was concerned with applying the legal licenses to the Qur’an and the Sunnah, so I studied the licenses and the fundamental study related to them, in which I relied on The main books, highlighting the applied aspect and linking it to the fundamentalist aspect, as that is the purpose of this study. I divided the research into an introduction, a preface, two sections, a conclusion, and indexes. In the introduction: I divided the positive ruling into intention and permission, and I defined intention and its parts, and I defined the legal permissions, their parts, their reasons, controls, and evidence for proving them. In the first section, I applied the legal licenses to the Holy Qur’an, and in the second section, I applied them to the Sunnah of the Prophet, explaining Branches of jurisprudence, studying the sayings of jurists in them, their evidence, and weighing between them, and linking that to the fundamentalist aspect, and explaining the extent to which Islamic law is easy, easy, and takes into account the conditions of those in charge, in their ease and hardship, especially in this time in which incidents and developments have abounded, and that it is enduring, immortal, and valid for all times and places.
