المستخلص: تناول هذا البحث قضية من القضايا المعاصرة والتي لها خطورتها البالغة التي تؤثر على الأشخاص والمجتمع على حد السواء، وهي قضية جائحة كورونا من خلال تطبيق قاعدة الأمور بمقاصدها على نقل هذه الجائحة؛ حيث إن القواعد الفقهية تساعد على فهم مناهج الفتوى والاطلاع حقائق الفقه ومداركه وتساعد على تخريج الفروع واستنباط الحلول لبعض المسائل المستجدة، كما أن تسليط الضوء على هذه القاعدة يبرز مدى أهمية القصد والنية واللذان هما مدار عمل المكلف، وبهما تتميز الأعمال؛ فجميع الأمور التي يقوم بها الإنسان المكلف وأفعاله ينظر فيها إلى مقصده ونيته؛ خاصة إذا تعلق هذا القصد وهذه النية بنقل مرض معد خطير كالكورونا والإيدز مثلا إلى شخص آخر أو إلى مجتمع بعينه، وبذا فيفرق في هذه الحالة بين تعمد الشخص لهذا الفعل أو كونه وقع منه خطئا دون قصد؛ وبذا فتختلف العقوبة وتتميز بين العمد والخطأ. والناظر في هذا الأمر يجد أنه بسبب قلة الوازع الديني لدى بعض الناس جعلهم لا يلتزمون بالإجراءات الاحترازية عند إصابتهم ببعض الأمراض المعدية، وربما اتخذوا هذه الأمراض كسلاح خفي للإضرار بشخص بعينه، وربما تعدى ذلك الأمر لقصد الإضرار بالمجتمع بأكمله، فجاء هذا البحث لمعالجة تلك القضية من خلال بيان قاعدة الأمور بمقاصدها وتطبيقها على جائحة كورونا للحد من هذا المرض ومنع انتشاره؛ وذلك لخطره الشديد والذي قد يؤدي في بعض الأحيان إلى مضاعفات خطيرة تتعلق بعمل أعضاء وأجهزة الجسد، أو ربما حتى إلى الوفاة.

This research dealt with one of the contemporary issues that has its extreme seriousness affecting people and society alike, and it is the issue of the Corona pandemic by applying the rule of matters with its intentions to transfer this pandemic; As the jurisprudential rules help to understand the methods of fatwa and knowledge of the facts of jurisprudence and its perceptions and help to graduate the branches and devise solutions to some emerging issues, and shedding light on this rule highlights the importance of intent and intention, which are the orbit of the work of the taxpayer, and by which actions are distinguished; So all the things that the assigned person does and his actions are considered according to his purpose and intention. Especially if this intent and this intention is related to transmitting a dangerous infectious disease such as corona and AIDS, for example, to another person or to a specific community; Thus, in this case, the difference is between the person intentionally doing this act or the fact that he made a mistake unintentionally. Thus, the punishment differs and distinguishes between intentional and wrongful. And the beholder in this matter finds that due to the lack of religious faith among some people, it made them not adhere to the precautionary measures when they were infected with some infectious diseases, and they may have taken these diseases as a hidden weapon to harm a specific person, and perhaps this matter went beyond that with the intention of harming the entire community, so this research came to address that issue from By stating the rule of matters with its purposes and application to the Corona pandemic to limit this disease and prevent its spread; This is due to its extreme danger, which may sometimes lead to serious complications related to the functioning of the organs and systems of the body, or perhaps even to death.
