المستخلص: هدف البحث: تميز الإمام الماوردي في كتابه الحاوي بمجموعة من المعالم المهمة لطالب العلم، أثرت في مكانة كتابه وشرحه، وجعلته من المراجع المهمة في المذهب الشافعي، ولذلك هدف الباحث إلى إظهارها للمشتغلين بالصناعة الفقهية؛ لتكون إضافة في هذا الجانب، وإثراء لطالب العلم عامة، وللمتفقه خاصة. منهج البحث: اتبعت في بحثي منهج الدراسة التحليلية، حيث أقوم بتتبع نصوص الماوردي في كتابه في الجزء المحدد، جامعا النصوص والشواهد لأحللها منتهياً إلى استنباط منهج الإمام الماوردي، ثم أبين هذا المنهج المستنبط في معالم واضحة مؤكداً عليها بذكر تطبيقات من خلال كتابه، وأذكر في الحاشية الأمثلة الأخرى في كتابه. الحدود الموضوعية: اقتصر على مقدمة المؤلف (الماوردي رحمه الله) والجزء من (كتاب الصيد والذبائح إلى آخر كتاب الأيمان) النتائج والتوصيات: خلص الباحث في بحثه إلى أهم النتائج، وهي: ظهور شخصية الإمام الماوردي في كتابه، واستقلاله الفكري، وبعده عن الجمود المذهبي، ومعرفة مكانة كتاب الحاوي عند أهل الصناعة الفقهية؛ لما تميز به من تحرير للمذهب الفقهي بصورة شاملة وفريدة وتحقيق علمي متميز. وأما أبرز التوصيات فهي: القراءة في مقدمات الكتب المهتمة بدراسة التراث، والعناية بها. من المواضيع التي يوصى بدراستها في كتاب الحاوي للماوردي: الأوجه والتخريجات من كتاب الحاوي. مقارنة بين كتاب نهاية المطلب للجويني والحاوي وبيان أوجه الاتفاق والاختلاف والتميز بين الشرحين.

Search goal: Imam Al-Mawardi distinguished himself in his book Al-Hawi with a group of important landmarks for the seeker of knowledge, which influenced the status of his book and its explanation and made it one of the important references in the Shafi’i doctrine, and therefore the researcher aimed to show it to those working in the jurisprudential industry. To be an addition in this aspect, and an enrichment for the seeker of knowledge in general, and for the scholar in particular. Research Methodology: In my research, I followed the analytical study method, where I trace the texts of Al-Mawardi in his book in the specified part, collecting texts and evidence to analyze them, ending with deducing the method of Imam Al-Mawardi, then I explain this deduced method in clear terms, confirming them by mentioning applications throughout his book, and I mention in the footnote other examples. In his book. Objective limits: Limit it to the introduction by the author (Al-Mawardi (may God have mercy on him) and the part (from the Book of Hunting and Sacrifices to the end of the Book of Faith) Results and recommendations: In his research, the researcher concluded the most important results, which are: the emergence of the personality of Imam Al-Mawardi in his book, his intellectual independence his distance from sectarian rigidity and knowledge of the status of Al-Hawi’s book among the jurisprudence; Because of his distinguished liberation of the jurisprudential doctrine in a comprehensive and unique manner and distinguished scientific investigation. The most prominent recommendations are: Reading introductions to books concerned with studying heritage and taking care of them. Among the topics recommended for study in Al-Hawi by AlMawardi:Aspects and conclusions from Al-Hawi’s book . A comparison between the book Nihayat al-Muttalib by al-Juwayni and al-Hawi, and an explanation of the areas of agreement, difference, and distinction between the two explanations.
